ORDINANCE NO. BL2015-1102
An ordinance amending Section 13.24.090 of the Metropolitan Code of Laws pertaining to alcoholic beverages in parks.
WHEREAS, pursuant to Section 11.1002 of the Metropolitan Charter, the Metropolitan Board of Parks and Recreation has the duty to supervise, control, and operate the park and recreation system of the Metropolitan Government; and,
WHEREAS, the Metropolitan Code authorizes the Board to permit the possession of beer, ale, and other alcoholic beverages in any park or recreation area under its control, in such places and at such times as it determines appropriate under its rules and regulations; and,
WHEREAS, the Metropolitan Code permits the sale of beer in parks and recreation areas under the supervision of the Board with certain restrictions, including a locational restriction limiting such sales to parks in the downtown area; and,
WHEREAS, the Board of Parks and Recreation receives a large number of requests to hold festivals, events, and ceremonies at parks located outside of the downtown area; and,
WHEREAS, the Board of Parks and Recreation wishes to amend the Metropolitan Code to meet the expectations and demand for usage of the metropolitan park system by allowing the sale of alcohol in Metropolitan parks county-wide with Board approval and appropriate permits.
BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
Section 1. That Section 13.24.090 of the Metropolitan Code is hereby amended by deleting the opening paragraph of Subsection B and replacing it with the following new language:
B. Notwithstanding any other provisions of this code, ordinances of the metropolitan government, sections of this chapter or private acts, there is permitted the sale and consumption of beer, ale, and other alcoholic beverages in parks or recreation areas under the supervision and control of the Board, subject to the following restrictions:
Section 2. That Section 13.24.090 of the Metropolitan Code is hereby amended by deleting the following: “, or before one p.m. on Sundays”.
Section 3. That Section 13.24.090 of the Metropolitan Code is hereby amended by deleting Subsection B.4 and replacing it with the following new language:
4. Beer, ale, and other alcoholic beverages may be sold and consumed at special events in parks and recreation areas that are under the supervision and control of the Metropolitan Board of Parks and Recreation, subject to the Board’s approval and appropriate state or local permits.
Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
