ORDINANCE NO. BL2015-1075

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 160 linear feet of an eight inch sanitary sewer main and easement and to construct approximately 231 linear feet of an eight inch PVC sewer main for properties located at 520 26th Avenue North and 26th Avenue North (unnumbered), (MWS Project No. 15-SL-2 and Proposal No. 2015M-010ES-001).

WHEREAS, the abandonment of 160 linear feet of an eight inch sanitary sewer mainline and easement and the construction of approximately 231 linear feet of an eight inch PVC sewer main for properties located at 520 26th Avenue North and 26th Avenue North (unnumbered) are needed to construct project number 15-SL-2; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-010ES-001 on February 19, 2015, for the abandonment and construction of said sewer mains and easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon 160 linear feet of an eight inch sanitary sewer main and easement and to construct approximately 231 linear feet of an eight inch PVC sewer main for properties located at 520 26th Avenue North and 26th Avenue North (unnumbered), as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
