Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Dr. Harold Wells of the Metropolitan Police Department.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Pursuant to regulations of the Tennessee Comptroller’s Office, when the Metropolitan Government undertakes a draw from one of our two commercial paper programs, the attached report must be submitted to the Metropolitan Council and presented at a meeting of that body before filed with the Comptroller.

As you can see from the attached report, on March 5, 2014, we issued $50 million of General Obligation Commercial Paper. Please find below a link to the City’s Investor Relations Page for additional information: http://www.nashville.gov/Finance/Office-of-the-Treasurer/Debt/Investor-Relations.aspx.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Action Commission
Reappointment of Ms. Karen Doty for a term expiring February 2, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire and Building Code Appeals Board
Reappointment of Mr. Thomas Lipscomb, Jr. for a term expiring March 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Gas/Mechanical Examiners Appeals Board
Appointment of Ms. Lynn Taylor for a term expiring August 21, 2016. Ms. Taylor will fill the unexpired term of Mr. Eloy Saban. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Reappointment of Mr. Greg Adkins for a term expiring March 31, 2018. At the request of the nominee, the confirmation was deferred.

Plumbing Examiners and Appeals Board
Appointment of Mr. Carl Krantz for a term expiring March 10, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2012-302

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of the Nashboro Village Planned Unit Development Overlay District for a portion of property located at Nashboro Boulevard (unnumbered), at the southwest corner of Nashboro Boulevard and Flintlock Court, zoned R10 (3.46 acres), to permit neighborhood retail uses not to exceed one story, where 27,600 square feet of commercial uses was previously approved, all of which is described herein (Proposal No. 74-79P-009). Ms. Johnson requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUN-A zoning for properties located at 1318, 1322 and 1326 6th Avenue North, at the southeast corner of 6th Avenue North and Taylor Street (0.88 acres), all of which is described herein (Proposal No. 2014Z-005PR-001). The bill was approved by the Planning Commission. Ms. Gilmore requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the ONE C1TY Specific Plan district approved for a mixed-use development for properties located at 329, 330, 331, and 336 28th Avenue North, 28th Avenue North (unnumbered) and 3000 Charlotte Avenue, southwest of the intersection of 28th Avenue and Charlotte Avenue (18.73 Acres), to permit temporary improvements, permit additional uses not currently permitted and increase the maximum building height, all of which is described herein (Proposal No. 2011SP-009-003). The bill was approved by the Planning Commission. Ms. Langster requested a hearing from the public on this bill which had been previously advertised. RESOLUTION NO. RS2014-1032

A resolution accepting a grant from the U.S. Department of Health and Human Services to the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to enhance access to a comprehensive continuum of high quality, community-based care for low income individuals and families with HIV disease. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1033

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide bioterrorism emergency preparedness services to the citizens of Davidson County. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1034

A resolution approving a cooperative agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and TriStar Centennial Medical Center to provide a Worksite POD for licensed medical employees and other licensed medical professionals specified by TriStar Centennial Medical Center with mass prophylaxis for distribution in the event of a public health emergency. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1035

A resolution approving a public health affiliation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Vanderbilt University to participate in a program of public health instruction and training for students of the university. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1036

A resolution approving a grant contract by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and Vanderbilt University Medical Center to host the New Life Program Boot Camp for New Dads Workshops. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1037

A resolution approving a grant agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and K & G Men’s Store to provide Dress to Impress Workshops for program participants in job readiness training. The resolution was approved by the Health, Hospitals and Social Services Committee.

RESOLUTION NO. RS2014-1038

A resolution approving an amendment to a lease agreement between The State of Tennessee and The Metropolitan Government of Nashville and Davidson County for certain real property located at 3000 Morgan Road, Joelton, TN (Proposal No. 2014M-004PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1039

A resolution accepting a grant from The Land Trust for Tennessee and authorizing the Director of Public Property, or his designee, to acquire certain real property by purchase and/or donation to The Metropolitan Government of Nashville and Davidson County for use as park land (Proposal No. 2014M-009PR-001). The resolution was approved by the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1040

A resolution approving and authorizing the execution of an Intergovernmental Agreement between the Metropolitan Government and the State of Tennessee, by and through the Tennessee Department of Transportation, and authorizing execution of a related quitclaim deed for any property interests the Metropolitan Government may have in some unused remnant right of way adjacent to Old Hickory Boulevard, and accepting consideration for same in the amount of $36,750.00 (Proposal No. 2014M-014PR-001).

RESOLUTION NO. RS2014-1041

A resolution approving an Interlocal Agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for pavement resurfacing of 6.71 miles of street surface located on Old Hickory Boulevard, from S.R. 254 Bell Road to Burkitt Road, (S.A. 19048(1). The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1042

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the State Route 6, Gallatin Pike, miscellaneous improvements from State Route 45, Old Hickory Boulevard to Anderson Lane under the Highway Safety Improvement Program in Davidson County, PIN 118409.00. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1043

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the I-65 Northbound and Southbound Ramps (Exit 81) at Wedgewood Avenue under the Highway Safety Improvement Program in Davidson County, PIN 117125.00. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1044

A resolution approving an Interlocal Agreement between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for pavement resurfacing of 2.432 miles of street surface located on Woodmont Boulevard, from S.R. 1 Harding Pike to Golf Club Lane, (S.A. 19029(2). RESOLUTION NO. RS2014-1045

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of James Allen Palmer against the Metropolitan Government of Nashville and Davidson County in the amount of $50,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1046

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Gabriel D. Hines and Colleen Hines against the Metropolitan Government of Nashville and Davidson County in the amount of $197,500.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1029

A resolution requesting the State of Tennessee to offer driver license examinations in Arabic. The resolution was approved by the
Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1047

A resolution recognizing and welcoming Vice-Mayor Dr. Rüdiger Koch from sister-city Magdeburg, Germany. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

The resolution was approved by the Budget and Finance Committee. RESOLUTION NO. RS2014-1048

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support legislation that would allow beer and other alcoholic beverages purchased at the Music City Center, Country Music Hall of Fame, and Omni hotel to be carried throughout the three facilities on a limited basis. The resolution was approved by the Rules-Confirmations-Public Elections Committee.
