RESOLUTION NO. RS2014-1039

A resolution accepting a grant from The Land Trust for Tennessee and authorizing the Director of Public Property, or his designee, to acquire certain real property by purchase and/or donation to The Metropolitan Government of Nashville and Davidson County for use as park land (Proposal No. 2014M-009PR-001).

WHEREAS, Jeffery L. Ackerman has agreed to sell to the Metropolitan Government all the interest he may possess in three parcels of property (the “Property”) known as 0, 5601 and 5611 Pettus Rd in the City of Antioch (also known as Davidson County Tax Map 174-00-0 Parcel 007.00 and Map 173-00-0 Parcels 095.00 and 096.00, respectively); and

WHEREAS, Section 2.24.250(F) of the Metropolitan Code of Laws provides: Where land in fee simple is being purchased for purposes other than for rights-of-way for highways, streets, roads, alleys and other places for vehicular traffic, the director of public property administration shall negotiate for the purchase of such property and seek to obtain from the owner an option to sell to the Metropolitan government at a fixed price, subject to the approval of the Metropolitan Council by resolution, and no purchase shall be consummated until it has been so approved by the Metropolitan Council; and

WHEREAS, pursuant to section 2.24.250(F) of the Metropolitan Code of Laws, the Director of Public Property Administration has negotiated an option (EXHIBIT A) to acquire real property located in Davidson County being Map No. 174-00 Parcel 007.00 and Map No. 173-00 Parcels 095.00 and 096.00 (see EXHIBIT B), and incorporated into this resolution by reference; and

WHEREAS, The Land Trust for Tennessee desires to grant funding to the Metropolitan Government in the amount of $190,000 to provide financial support for the purchase of the Property (see EXHIBIT C); and,

WHEREAS, the Metropolitan Board of Parks and Recreation has approved the grant and the acceptance of the Property; and,

WHEREAS, it is in the best interest of the citizens of Nashville and Davidson County to accept this grant and to approve the purchase of said property;

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the grant by and between The Land Trust for Tennessee, in an amount not to exceed $190,000.00, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide financial support for the purchase of the certain property in Davidson County, a copy of which grant is attached hereto and incorporated herein, is hereby approved.

Section 2. That the amount of this grant be appropriated to the Metropolitan Nashville Parks Department based on the revenues estimated to be received and any match to be applied.

Section 3. That the Director of Public Property, or his designee, is hereby authorized to exercise the option to purchase the property known as 0, 5601 and 5611 Pettus Rd. in Antioch, TN (also known as Davidson County Tax Map 174-00 Parcel 007.00 and Map 173 Parcels 095.00 and 096.00) as described in Exhibit A and to execute the necessary documents pertaining thereto.

Section 4. That this resolution shall take effect upon passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
