ORDINANCE NO. BL2014-719

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Pasquo Road Stormwater Improvement Project for three properties located at 441 Union Bridge Road, 5954 Pasquo Road, and Pasquo Road (unnumbered), (Project No. 14-SWC-109 and Proposal No. 2014M-007ES-001).

WHEREAS, the negotiation and acceptance of permanent easements for three properties located at 441 Union Bridge Road, 5954 Pasquo Road, and Pasquo Road (Unnumbered), are needed to construct Stormwater Project 14-SWC-109; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-007ES-001 on January 29, 2014, for the negotiation and acceptance of permanent easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept permanent easements for three properties located at 441 Union Bridge Road, 5954 Pasquo Road and Pasquo Road (Unnumbered) as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
