ORDINANCE NO. BL2013-619

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to IWD zoning for properties located at McGavock Pike (unnumbered), approximately 1,850 feet north of Harding Place and partially located within the Floodplain Overlay District (88.81 acres), all of which is described herein (Proposal No. 2013Z-031PR-001).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By changing from R10 to IWD zoning for properties located at McGavock Pike (unnumbered), approximately 1,850 feet north of Harding Place and partially located within the Floodplain Overlay District (88.81 acres), being Property Parcel Nos. 013, 297 as designated on Map 134-00 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the attached sketch, which is attached to and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Map 134 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2013-619 by renumbering Section 3 as Section 4 and by adding the following new Section 3:

Section 3. Be it further enacted, that the following landscape buffer yard and setback requirements shall be applicable for any development of the property being rezoned by this Ordinance, notwithstanding any standard buffer yard and bulk standard requirements included in the Metropolitan Zoning Code for IWD property to the contrary:

1. Map 134-00, Parcel 13 at northern property line abutting residentially-zoned property:
50 foot wide landscape buffer yard located at the perimeter of the property along northern property boundary abutting existing residentially-zoned parcels shall be provided at time of development. Landscape density per 100 linear feet shall be: 8 canopy trees, 4 understory trees, and 24 shrubs.
Existing native plant material should be retained and supplemented as needed in order to obtain the minimum landscape density requirement noted.
2. Map 134-00, Parcel 13 at western property line abutting existing residentially-zoned parcels:
50 foot wide landscape buffer yard located at the perimeter of the property along western property boundary abutting existing residentially-zoned parcels shall be provided at time of development. Landscape density per 100 linear feet shall be: 10 canopy trees, 5 understory trees, and 30 shrubs. Utility easements shall not reduce buffer requirements of width or density and may require buffer on both sides of utility easement to reach 50 foot width requirement.
Existing native plant material should be retained and supplemented as needed in order to obtain the minimum landscape density requirement noted.
3. Map 134-00, Parcel 13 rear setback:
A 100 foot rear setback shall be provided along the perimeter of the property along the western property boundary. The Permitted Setback Obstructions noted in section 17.12.040.E. of the Metropolitan Zoning Code as of the date of enactment of this ordinance shall apply.
4. All other landscaping development standards, regulation, and requirements not specifically mentioned above shall be subject to the standards, regulation, and requirements of the IWD zoning district as of the date of the applicable request or application as noted in the Metro Zoning Ordinance.
