RESOLUTION NO. RS2014-1043

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the I-65 Northbound and Southbound Ramps (Exit 81) at Wedgewood Avenue under the Highway Safety Improvement Program in Davidson County, PIN 117125.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation seek to enter into an intergovernmental agreement to include the construction for the I-65 Northbound and Southbound ramps (Exit 81) at Wedgewood Avenue under the Highway Safety Improvement Program in Davidson County, PIN 117125.00; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County is required to accept a General Maintenance Agreement from the State of Tennessee, Department of Transportation, for the I-65 Northbound and Southbound ramps (Exit 81) at Wedgewood Avenue under the Highway Safety Program in Davison County PIN 117125.00; and,

WHEREAS, the I-65 Northbound and Southbound ramps (Exit 81) at Wedgewood Avenue project includes safety improvements with new traffic signal in Davidson County PIN 11725.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the I-65 Northbound and Southbound ramps (Exit 81) at Wedgewood Avenue under the Highway Safety Program in Davidson County, PIN 117125.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That The Metropolitan Government pursuant to this intergovernmental agreement shall maintain the traffic signals for the I-65 Northbound and Southbound ramps (Exit 81) at Wedgewood Ave.

Section 3. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
