RESOLUTION NO. RS2014-1038

A resolution approving an amendment to a lease agreement between The State of Tennessee and The Metropolitan Government of Nashville and Davidson County for certain real property located at 3000 Morgan Road, Joelton, TN (Proposal No. 2014M-004PR-001).

WHEREAS, Metropolitan Code of Laws Section 2.24.210 provides that, “Any leases of public property, except leases of space in the Stahlman Building, shall be subject to the approval of the metropolitan council;” and,

WHEREAS, The Metropolitan Government entered into a Lease dated January 18, 2005, for real property (the “Property”) located at 3000 Morgan Road, Joelton, TN which was approved by Ordinance BL2004-247; and,

WHEREAS, the parties desire to amend the Lease as set forth in the First Amendment to Lease (“Amendment”), attached hereto as Exhibit A, to permit the State to construct and operate a communications tower on the Property upon the terms and conditions set forth herein; and,

WHEREAS, The Metropolitan Park Board has approved the proposed amendment; and,

WHEREAS, Ordinance BL2004-247 provided that any amendments to the Lease shall be approved by resolution of the Metropolitan Council receiving twenty-one affirmative votes; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this Amendment to the Lease Agreement be approved.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the attached First Amendment to Lease (Exhibit A) between The State of Tennessee and The Metropolitan Government of Nashville and Davidson County is hereby approved, the Metropolitan Mayor is authorized to sign, and the Director of Public Property Administration is authorized to execute said amendment.

Section 2. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
