ORDINANCE NO. BL2014-718

An ordinance approving an agreement by and between the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Arts Commission, and the Frist Center for the Visual Arts to use the Frist Center for an event during the Americans for the Arts 2014 Annual Convention; and, authorizing the execution of the same.

WHEREAS, on March 5, 2013, the Metropolitan Council approved Ordinance No. BL2013-358 approving an agreement by and between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Arts Commission, and the Americans for the Arts (“AFTA”) regarding the Americans for the Arts 2014 Annual Convention and Pre-Conference in Nashville, TN, and funding thereof; and,

WHEREAS, the Convention is scheduled to occur from June 12, 2014 through June 15, 2014 in Nashville, TN; and,

WHEREAS, as part of the agreement with AFTA, it was agreed that the Metropolitan Nashville Arts Commission is responsible for fully supporting and producing two evening events at the AFTA Convention, including an opening reception and the dinner for the Americans for the Arts Board and convention sponsors; and,

WHEREAS, M.C.L. Section 2.112.040 authorizes the Arts Commission to “accept and receive gifts donated to the commission for artistic and cultural purposes” and to receive and expend money donated to the commission; and,

WHEREAS, the First Center has graciously agreed to provide an in-kind donation of its facilities for the dinner for the Americans for the Arts Board and convention sponsors.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Arts Commission, and the Frist Center for the Visual Arts for use of the Frist Center for the dinner for the Americans for the Arts Board and convention sponsors associated with the AFTA convention, a copy of this agreement is attached hereto and incorporated herein, is hereby approved and the Director of the Arts Commission is authorized to execute the same.

SECTION 2. That any amendments, renewals or extensions of the terms of the agreement shall be approved by Resolution of the Metropolitan Council.

SECTION 4. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
