RESOLUTION NO. RS2014-1042

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for the State Route 6, Gallatin Pike, miscellaneous improvements from State Route 45, Old Hickory Boulevard to Anderson Lane under the Highway Safety Improvement Program in Davidson County, PIN 118409.00.

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Transportation seek to enter into an intergovernmental agreement to include miscellaneous improvements for State Route 6, Gallatin Pike from State Route 45, Old Hickory Boulevard (log mile 18.59) to Anderson Lane (log mile 19.32) under the Highway Safety Improvement Program in Davidson County, PIN 118409.00; and,

WHEREAS, The Metropolitan Government of Nashville and Davidson County is required to accept a General Maintenance Agreement from the State of Tennessee, Department of Transportation, for State Route 6, Gallatin Pike from State Route 45, Old Hickory Boulevard to Anderson Lane under the Highway Safety Program in Davison County PIN 118409.00; and,

WHEREAS ,the State Route 6, Gallatin Pike from State Route 45, Old Hickory Boulevard to Anderson Lane project includes the installation of various signs, refurbish pavement markings, pedestrian facility upgrades and signal modifications in Davidson County PIN 118409.00; and,

WHEREAS, Tennessee Code Annotated, Section 12-9-104(b) authorizes the Metropolitan Government of Nashville and Davidson County to enter into intergovernmental agreements with the State of Tennessee by resolution; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this intergovernmental agreement be approved.

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for State Route 6, Gallatin Pike, miscellaneous improvements from State Route 45, Old Hickory Boulevard to Anderson Lane under the Highway Safety Program in Davidson County, PIN 118409.00, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That The Metropolitan Government pursuant to this intergovernmental agreement shall be maintain the traffic signals for State Route 6, Gallatin Pike miscellaneous improvements from State Route 45, Old Hickory Boulevard to Anderson Lane.

Section 3. Any amendments, renewals, or extension of the terms of the agreement may be approved by resolution of the Metropolitan Council.

Section 4. That this resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
