Metropolitan Council Meeting
Tuesday, November 1, 2005


The Metropolitan Council met in regular session on this date at 7:00 p.m. in Metro City Hall.

The invocation was offered by Reverend Elvin Woodruff of Church of the Living God C.W.F.F.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Hart, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, McClendon, Greer, Hausser, Wallace, Walls, Whitmore, Crafton, Summers, Shulman, Adkins, Foster, Alexander, Wilhoite, Kerstetter, Toler, Coleman, Bradley, Williams, Tygard and President Gentry (39); Absent: (0).

The Minutes of the meeting of October 18, 2005, were approved.

- ELECTIONS AND CONFIRMATIONS -

Health and Educational Facilities Board
The President called for nominations to fill one (1) vacancy on the Health and Educational Facilities Board of The Metropolitan Government of Nashville and Davidson County. Mr. Wallace nominated Dr. Huey Newberry; Ms. Gilmore nominated Ms. Saletta Holloway; and Mr. Shulman nominated Mr. R. Walker Batts. There being no further nominations, the nominations ceased. The nominees were referred to the Rules-Confirmations-Public Elections Committee for a recommendation, and an election will be conducted at the next regular meeting of the Council.

- BILLS ON PUBLIC HEARING -

BILL NO. BL2005-648

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.32.050 to permit signs with graphics or electronic displays along a four-lane or controlled access highway, all of which is more specifically described herein (Proposal No. 2005Z-056T). Mr. Dozier moved to defer the bill to the January public hearing and re-refer the bill to the Planning Commission, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-747

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to CS district property at Hester Avenue (unnumbered), 220 feet south of Glenrose Avenue (0.18 acres), all of which is described herein (Proposal No. 2004Z-030U-11). The bill was approved by the Planning Commission.

BILL NO. BL2005-748

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development district located at 2204 Nolensville Pike, and Hester Avenue (unnumbered), 250 feet south of Glenrose Avenue, to permit an expansion of the existing car sale operation with a proposed 1,350 square foot building (0.45 acres), all of which is described herein (Proposal No. 2004P-029U-11). The bill was approved by the Planning Commission.

Ms. McClendon requested a hearing from the public on these bills which had been previously advertised. The President asked if anyone desired to be heard for or against the bills, and no one came forward to be heard. The President declared the public hearing closed. Ms. McClendon moved to pass the bills on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-800

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS10 district a portion of properties located at 5791 Cane Ridge Road and Cane Ridge Road (unnumbered) (57.95 acres), all of which is described herein (Proposal No. 2005Z-066G-12). The bill was approved by the Planning Commission. Mr. Coleman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and a citizen was heard in favor of passage of the bill. The President declared the public hearing closed. Mr. Coleman moved to pass the bill on second reading and defer the bill indefinitely, the bill being requested by Dale and Associates, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-801

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a commercial Planned Unit Development district, located at 5007 Gallatin Pike, south of Briley Parkway (4.73 acres), approved for a 5,200 square foot museum, and a 1,000 square foot souvenir shop, all of which is described herein (Proposal No. 121-80-U-05). The bill was disapproved by the Planning Commission.

BILL NO. BL2005-802

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development district, located at Joyce Lane (unnumbered), south of Briley Parkway (9.79 acres), approved for 96 condominium units, all of which is described herein (Proposal No. 106-80-U-05). The bill was disapproved by the Planning Commission.

BILL NO. BL2005-803

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5 to SCR district properties located at 1001, 1003, 1005, 1007, 1009, 1011, 1013, 1015 Joyce Lane, and Joyce Lane (unnumbered), and 5007 Gallatin Pike (16.27 acres), all of which is described herein (Proposal No. 2005Z-137U-05). The bill was disapproved by the Planning Commission.

Mr. Craddock moved to defer the bills to the January public hearing for a Planning Commission recommendation, the bills being requested by Kroeger Real Estate, which motion was seconded and adopted by a voice vote of the Council, with Mr. Bradley "abstaining."

BILL NO. BL2005-804

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to OL district a portion of property located at 5441 Edmondson Pike (2.10 acres), all of which is described herein (Proposal No. 2005Z-124U-12). The bill was approved by the Planning Commission. Mr. Foster requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Foster moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM15 to MUL district property located at Central Pike (unnumbered) (2.62 acres), all of which is described herein (Proposal No. 2005Z-130G-14). The bill was approved by the Planning Commission.

BILL NO. BL2005-811

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a portion of a Residential Planned Unit Development located on the south side of Central Pike, east of Dodson Chapel Road, and proposed for 10,700 square feet of office, to allow for the development of 31,920 square feet of office and retail space (2.62 acres), all of which is more particularly described herein (Proposal No. 189-73-G-14). The bill was approved by the Planning Commission.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to CS district a portion of property located at 519 Bell Road, south of Murfreesboro Pike (1.06 acres), all of which is described herein (Proposal No. 2005Z-065U-13).

BILL NO. BL2005-813

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development located on the west side of Bell Road, south of Murfreesboro Pike, to allow for the development of a 5,301 square foot car wash (1.06 acres), all of which is described herein (Proposal No. 2005P-025U-13). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a Planned Unit Development district at 3161 Hamilton Church Road, located abutting the south side of Hamilton Church Road, 1,600 feet east of Murfreesboro Pike (6.0 acres), approved for 27 single-family lots, all of which is described herein (Proposal No. 2004P-022U-13). The bill was approved by the Planning Commission.

BILL NO. BL2005-824

BILL NO. BL2005-827

BILL NO. BL2005-829

BILL NO. BL2005-831

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending the Hillsboro Village Urban Design Overlay (UDO) district to modify variations to the conventional standards of the underlying zoning, all of which is more particularly described herein (Proposal No. 2005UD-009U-10). The bill was approved by the Planning Commission. Ms. Hausser requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Ms. Hausser moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-834

An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.40.720 pertaining to the public notification requirements for public hearings conducted by the Board of Zoning Appeals, all of which is more particularly described herein (Proposal No. 2005Z-153T). Mr. Summers moved to defer the bill to the January public hearing, for a Planning Commission recommendation, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-835

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL to CS district property located at 4648 Old Hickory Boulevard, approximately 1,500 feet north of Lebanon Pike (0.36 acres), all of which is described herein (Proposal No. 2005Z-114G-14). The Planning Commission voted to make to no recommendation on the proposal. Mr. Brown requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and no one came forward to be heard. The President declared the public hearing closed. Mr. Brown moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
