ORDINANCE NO. BL2005-748

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of a Planned Unit Development district located at 2204 Nolensville Pike, and Hester Avenue (unnumbered), 250 feet south of Glenrose Avenue, to permit an expansion of the existing car sale operation with a proposed 1,350 square foot building (0.45 acres), all of which is described here in (Proposal No. 2004P-029U-11).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by changing the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of Title 17 by reference, as follows:

By making applicable the provisions of a Planned Unit Development district located at 2204 Nolensville Pike, and Hester Avenue (unnumbered), 250 feet south of Glenrose Avenue, to permit an expansion of the existing car sale operation with a proposed 1,350 square foot building (0.45 acres), as being Property Parcel No. 081 as designated on Map 118-04 and parcel 44 as designated on Map 119-01 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is described by lines, words and figures on the plan that was duly considered by the Metropolitan Planning Commission, and which is on file with the Metropolitan Planning Department and made a part of this ordinance as though copied herein.

Section 2. Be it further enacted, that the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 118 and 119 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 3. Be it further enacted, that this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

Mr. President:

I move to amend Ordinance No. BL2005-748 as follows:

1. By renumbering Section 2 as Section 3.

2. By renumbering Section 3 as Section 4.

3. By adding the following new Section 2.:

Section 2. Be it further enacted, that the following conditions shall apply to the Planned Unit Development:
1. No automotive repair or automotive body work shall be conducted on the property, other than minor maintenance of vehicles for sale.
2. No inoperable vehicles shall be stored on the premises.
3. No mobile office units shall be permitted on the property, including mobile homes and trailers.
4. Only low lux lighting shall be used for the exterior areas of the property.
5. Dumpster shall be emptied between the hours of 7 a.m. and 8 p.m. only.
6. No billboard signs larger than the existing billboard on the property shall be permitted.
