Metropolitan Council Meeting

Tuesday, April 7, 1998


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Charles Fentress.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Varallo, Armistead, Steine, Ferrell, Waters, Patton, Black, Nollner, Majors, Harrison, Beehan, Campbell, Hart, Wooden, Ponder, French, Stanley, Dale, Graves, Clifton, Sloss, Haddox, McCallister, Holt, Crafton, Johns, Kleinfelter, Arriola, Sontany, Hall, Holloway, Hollis, Jenkins, Turner, Fentress, Lineweaver, and President West (37); Absent: Dillard, Garrett, Douglas, Alexander (4).

The Minutes of the regular meeting of March 17, 1998 were approved.

The President called for an election to fill an unexpired term on the Industrial Development Board of the Metropolitan Government, the nomination of Mr. Aubrey Gregory having been previously made. Mr. Harrison, Chairman of the Rules-Confirmations-Public Elections-Aviation Committee, reported that the Committee had considered and recommended the election of Mr. Gregory. The vote was called, and the President announced that Aubrey Gregory was elected to the Industrial Development Board of the Metropolitan Government to fill an unexpired term ending August 23, 2001.

Mr. Lineweaver moved that the date of the first regular Council meeting in May be moved from May 5, 1998 to May 7, 1998, because of a conflict with the county primary elections. The motion was seconded and duly adopted.

A resolution honoring Mrs. Martha Hardcastle Warfield. The resolution was previously approved by the Rules-Confirmations-Public Elections-Aviation Committee. Mr. Fentress moved that the Council again adopt the resolution, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. R98-1078

A resolution appropriating the amount of $5,308,979 from the General Fund Reserve Fund for the purchase of equipment, and for making repairs to buildings for various departments of The Metropolitan Government of Nashville and Davidson County. A resolution amending the 1997-98 to 2002-2003 Capital Improvements Budget (Ordinance No. O97-791) to add a Public Education and Government Committee project (Project No. 971PE001). A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to enact necessary legislation to allow recall provisions of the Metropolitan Charter to be applicable in the area of the Metropolitan Government. The Rules-Confirmations-Public Elections-Aviation Committee recommended deferment of the resolution. Mr. Johns moved to defer action on the resolution, upon the Committee’s recommendation, which motion was seconded and adopted by a voice vote of the Council.

A resolution requesting Intermedia to refrain from increasing monthly cable rates for subscribers in Metropolitan Nashville and Davidson County. A resolution proposing an amendment to the Charter of The Metropolitan Government of Nashville and Davidson County by deleting Section 1.07, Subsection A, in its entirety, which subsection currently limits persons serving in elective offices authorized or created by the Metropolitan Charter to two (2) terms. The Charter Revision Committee recommended deferment of the resolution. Ms. Sontany moved to defer action on the resolution to the second meeting in May, which motion was seconded and adopted by a voice vote of the Council.

A resolution appropriating certain 1998 Housing and Community Development funds. The resolution was approved by the Federal Grants Review Committee. An ordinance authorizing the acquisition of property by negotiation or condemnation for the purpose of acquiring land for the use in Public Project No 97-SC-5, Apex storm inlet and appurtenances at Apex Street and McFerrin-Granada Connector with specific relation to the construction of the Second Avenue tunnel. The bill was approved by the Planning Commission. An ordinance approving the sale of certain property held by The Metropolitan Government of Nashville and Davidson County (Map 81-7, Parcel 209; 1925 16th Avenue North).
