ORDINANCE NO. O98-1118

AN ORDINANCE APPROVING A CONTRACT BETWEEN THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY AND THE CITY OF BERRY HILL CONCERNING A TRAFFIC SIGNAL.

WHEREAS, an agreement has been negotiated whereby the City of Berry Hill will maintain and pay all costs of operating the traffic signal located at the intersection of Thompson Lane, Powell Road and West Iris Drive; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that the contract be executed;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the contract between the City of Berry Hill and The Metropolitan Government of Nashville and Davidson County concerning the traffic signal located at the intersection of Thompson Lane, Powell Road and West Iris Drive, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That amendments to the contract referenced herein shall be approved by resolution of the Metropolitan Council, by twenty-one affirmative votes.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
