ENACTED 04/07/1998

WHEREAS, The Metropolitan Government of Nashville and Davidson County entered into a Trunk and Treatment Agreement with the City of La Vergne; and

WHEREAS, The Metropolitan Department of Water and Sewerage Services has determined that it has the resources to conduct the Industrial Waste Program inside the City of La Vergne’s sewerage service area and wishes to amend the Trunk and Treatment Agreement to so provide; and

WHEREAS, The City of La Vergne has executed this amendment with the Metropolitan Government for Metro to assume responsibility for City’s Industrial Waste Program.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan County Mayor be, and is hereby authorized to enter into an amendment to the August 9, 1984 agreement between the Metropolitan Government and the City of La Vergne, a copy of which is attached hereto.

SECTION 2: That subsequent amendments to the Agreement of August 9, 1984, and any amendments thereto may be authorized by Resolution by twenty-one affirmative votes of the Metropolitan Council.

SECTION 3: That the Metropolitan County Mayor or his designee is hereby authorized to and directed to ensure the performance of the provisions of the agreement as they effect The Metropolitan Government.

SECTION 4: That this Ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
