ORDINANCE NO. O98-1142

AN ORDINANCE ABANDONING A PORTION OF SEWER EASEMENT ENCUMBERING ALONG REAR LOT LINES of LOTS 59 AND 60 OF THE PLAN OF LOTS IN NASHVILLE TENNESSEE, R.O.D.C. BOOK "U", PAGE 212, PROJECT NO. 70-S-6A, AND AUTHORIZING THE METROPOLITAN MAYOR TO EXECUTE THE ATTACHED DOCUMENT.

WHEREAS, Youth Hobby Shop Inc. is the owner of real property encumbered by sewer easements; and,

WHEREAS, Youth Hobby Shop Inc. has installed a new sewer line which adequately serves the lots and the neighboring properties; and,

WHEREAS, a portion of the easement not of record, is no longer being used by the Department of Water and Sewerage Services; as shown on the plans for Project No. 70-S-6A, more particularly described on the plans for Project No. 97-SL-126, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said portion of easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That a portion of the sewer easement not of record is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments, attached as Exhibit A, to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
