ENACTED 04/07/1998

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to " purchase or otherwise acquire property for any public purpose."; and

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government "to establish, maintain and regulate a system of free schools "; and

WHEREAS, it is in the public interest that certain property be acquired through negotiation or condemnation for the purpose of acquiring land for a new facility for Whitsitt Elementary School.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation property for the purpose of constructing, maintaining and operating a new facility for Whitsitt Elementary School.

SECTION 2. The Director of Public Property Administration, or his designee, is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the properties shown on Exhibit A and identified as Parcels 236 and 237 on Tax Map 119-10 and Parcels 360, 361 and 367 on Tax Map 119-06.

SECTION 3. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
