Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Gordon Dona hoe of Neely’s Bend Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Cooper, Gilmore, Mendes, Hurt, Shulman, Hastings, Haywood, Swope, Scott Davis, Withers, Anthony Davis, VanReece, Pridemore, Pardue, Hagar, Glover, Rhoten, Syracuse, Freeman, Sledge, Allen, O’ Connell, Roberts, Kindall, Weiner, Mina Johnson, Murphy, Pulley, Elrod, Blalock, Vercher, Karen Johnson, Potts, Bedne, Dowell, Coleman, Henderson, Rosenberg and Briley (39); Absent: Huezo (1).

The Minutes of the regular meeting of April 19, 2016 were approved.

- ELECTIONS AND CONFIRMATIONS -

CATV Special Committee
Reappointment of Mr. Tim K. Garrett for a term expiring March 1, 2019. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Board
Appointment of Mr. Thomas Greer for a term expiring February 15, 2019. Mr. Greer will fill the unexpired term of Mr. Michael Thomas. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2016-189

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning for property located at 7224 Old Burkitt Road, approximately 300 feet east of Nolensville Pike (23.08 acres), to permit 99 single-family lots, all of which is described herein (Proposal No. 2016SP-008-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Bedne requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Bedne moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-190

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to R6 zoning for property located at 715 Stockell Street, at the southeast corner of Stockell Street and Hancock Street (0.20 acres), all of which is described herein (Proposal No. 2015Z-089PR-001). The bill was disapproved by the Planning Commission. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Davis moved to pass the bill on second reading and re-refer the bill to the Planning Commission, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to OR20-A zoning for property located at 753 Alloway Street, approximately 440 feet east of 8th Avenue South (0.15 acres), all of which is described herein (Proposal No. 2016Z-016PR-001).

The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Allen requested a hearing from the public on this bill which had been previously advertised. The bill was approved by the Planning Commission with. Ms. Roberts requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Beaman & Turner Properties Specific Plan District for properties located at 5430, 5438, 5446, and 5448 Cane Ridge Road and Cane Ridge Road (unnumbered), 4001 Cane Ridge Parkway, and 3135 Old Franklin Road, west of Interstate 24 (301.43 acres) to add approximately 13.8 acres into the SP, all of which is described herein (Proposal No. 2015SP-005-003). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Dowell requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of the Contextual Overlay District to various properties located along Boyce Court, Buena Vista Pike, Charles Court, Dove Place, Dyer Court, East Fairview Drive, Eve Circle, Flicker Drive, Harold Prewett Drive, Haynes Park Court, Haynes Park Drive, Hummingbird Drive, Kings Lane, Kingview Court, Kingsview Drive, Mallard Drive, Pheasant Drive, Tucker Road, West Hamilton Avenue, and Walters Court (231.8 acres), all of which is described herein (Proposal No. 2016Z-037PR-001). Ms. Hurt moved to defer the bill to the July public hearing, which motion was seconded and approved by a voice vote of the Council.

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to facilitate the planning, implementation, and evaluation of community-driven and evidence-based health promotion programs to Davidson County residents. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-209

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, for Healthy Start Home Visiting Program Services for qualified families. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-210

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide comprehensive care coordination services to eligible children with special healthcare needs. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-211

A resolution approving Amendment Two to a sub-recipient grant agreement by and between the Metropolitan Development and Housing Agency (MDHA) and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Social Services/Metropolitan Homelessness Commission, to provide rental and utility deposits for individuals assessed as chronically homeless using the Vulnerability Index. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-212

A resolution approving three amendments to three agreements between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, Department of Environment and Conservation, concerning maintenance of closed solid waste disposal facilities. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2016-213

A resolution approving two Intergovernmental Agreements by and between the State of Tennessee, Department of Transportation, and The Metropolitan Government of Nashville and Davidson County, acting by and through its Department of Public Works, for the reimbursement of two railroad crossing safety improvements at McGavock Pike (04510), Railroad Crossing number #350221S, State Project No: 19960-2544-94, Federal Project No: HSIP-R-4510(10), PIN Number 120254.00. RESOLUTION NO. RS2016-214

A resolution congratulating Nashville Christian School on winning the 2015 TSSAA Class 1A State Football Championship. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

A resolution to honor and recognize the 8th Mark Kendall Bingham Memorial Tournament, to be held May 22-29, 2016 in Nashville. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

A resolution proclaiming the week of May 15th, 2016 to be “Suburban Safe Driving Week” in Nashville & Davidson County to advance recognition of the importance of safe driving in Nashville’s neighborhoods. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-219

A resolution requesting amendment to Regulation No. 3 of the Metropolitan Board of Health, Division of Pollution Control, regarding new source review. The Health, Hospitals, and Social Services Committee recommended deferment. Mr. Bedne moved to defer the resolution to the first meeting in June, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-220

An ordinance amending Section 2.40.115 of the Metropolitan Code of Laws regarding reporting litigation matters to the Metropolitan Council. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2016-221

An ordinance amending Title 6 of the Metropolitan Code of Laws to eliminate Chapter 6.12 regulating dances and dance halls. Upon motion duly seconded, the bill passed first reading and was referred to the Convention, Tourism, and Public Entertainment Facilities and Public Safety, Beer, and Regulated Beverages Committee by a voice vote of the Council.

BILL NO. BL2016-222

An ordinance to amend various sections of chapter 8.04 of the Metropolitan Code of Laws to revise the duration of required rabies vaccinations for dogs, the related labeling of immunity periods, and to require notice of license expiration and provision of low-cost rabies vaccine clinics by the Metro Public Health Department. Upon motion duly seconded, the bill passed first reading and was referred to the Health, Hospitals, and Social Services Committee by a voice vote of the Council.

BILL NO. BL2016-223

An ordinance to amend Titles 12 and 16 of the Metropolitan Code of Laws of Nashville and Davidson County to establish a speed limit at major construction and demolition sites and to provide appropriate signage. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works, Public Safety, Beer, and Regulated Beverages, and Traffic, Parking and Transportation Committees by a voice vote of the Council.

BILL NO. BL2016-224

An ordinance granting the Purchasing Agent the authority to extend the terms of contract numbers 19448 and 19572 for program and construction management services pertaining to the Department of Water and Sewerage Services overflow abatement consent decree program. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

An ordinance authorizing the Director of Public Property Administration to enter into a Lease Agreement (attached as “Exhibit 1”) with JDJP Development, LLC for temporary office space at 749 Massman Drive, Nashville, Tennessee (Proposal No. 2016M-013PR-001 ).
