Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Anthony Davis.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Agricultural Extension Board
Appointment of Ms. Laura Bigbee-Fott for a term expiring August 1, 2017. Ms. Bigbee-Fott will fill the unexpired term of Ms. Mary Jane Hurt. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Civil Service Commission
Reappointment of Mr. Steve Corbitt for a term expiring March 31, 2021. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Emergency Communications District Board
Reappointment of Ms. Ruby Baker for a term expiring February 14, 2020. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Michelle Jernigan for a term expiring February 14, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Appointment of Ms. Brenda Diaz for a term expiring March 31, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Brian Tibbs for a term expiring March 31, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historic Zoning Commission
Appointment of Mr. J. Cyril Stewart for a term expiring June 1, 2017. Mr. Stewart will fill the unexpired term of Mr. Brian Tibbs. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Parks and Recreation
Appointment of Ms. Michelle Steele for a term expiring March 30, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTIONS ON PUBLIC HEARING –

RESOLUTION NO. RS2016-170

A resolution exempting Starbucks / CCH Cafe, LLC located at 3005 West End Avenue from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The Public Safety, Beer, and Regulated Beverages Committee recommend indefinite deferral at the request of the sponsor. Mr. Kindall moved to defer the resolution indefinitely, which motion was seconded and approved by a voice vote of the Council.

RESOLUTION NO. RS2016-171

A resolution exempting Steadfast Fine Coffee located at 603 Taylor Street from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Ms. Gilmore requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. - BILLS ON PUBLIC HEARING -

BILL NO. BL2016-153

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS15 zoning for property located at 900 Old Lebanon Dirt Road, at the northeast corner of Old Lebanon Dirt Road and North New Hope Road (0.47 acres), all of which is described herein (Proposal No. 2015Z-093PR-001). The bill was approved by the Planning Commission. Mr. Glover requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Glover moved to defer the bill to the first meeting in May, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-154

A request to rezone from MUL to MUN zoning for properties located at 2401 Lakeshore Drive, approximately 385 feet east of Dabbs Avenue (4.16 acres), requested by Councilmember Larry Hagar, applicant; 2401 Lakeshore Eat, LLC, owners. (Proposal No. 2016Z-026PR-001). Mr. Hagar moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2016-155

An ordinance amending Chapter 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the waiver of a Traffic Impact Study (Proposal No. 2016Z-005TX-001). Ms. Weiner moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-166

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Neighborhood Landmark Overlay District to property located at 4909 Indiana Avenue, approximately 245 feet west of 49th Avenue North, (0.55 acres), zoned R6, all of which is described herein (Proposal No. 2016NL-001-001). The bill was approved by the Planning Commission. Ms. Roberts requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Roberts moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-167

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUL-A zoning for property located at 4100 Charlotte Avenue, approximately 210 feet west of 40th Avenue North (0.94 acres), all of which is described herein (Proposal No. 2016Z-014PR-001).
The bill was approved by the Planning Commission. Ms. Murphy requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Murphy moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-168

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning for properties located at 6960 and 6968 Nolensville Pike and 7203 and 7235 Old Burkitt Road, at the corner of Nolensville Pike and Burkitt Road, (6.72 acres), to permit a maximum of 5,200 square feet of automobile convenience and restaurant uses and all uses permitted within the CL zoning district with some exceptions, all of which is described herein (Proposal No. 2015SP-098-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Bedne requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in opposition to passage of the bill. The President declared the public hearing closed. Mr. Bedne moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-169

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to SP zoning for property located at 1212 Pennock Avenue, approximately 290 feet south of Douglas Avenue (0.16 acres), to permit two detached homes, all of which is described herein (Proposal No. 2015SP-111-001). The bill was disapproved by the Planning Commission. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Davis moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-171

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CL to SP for a portion of property located at 3798 Nolensville Pike, approximately 475 feet north of Elysian Fields Road (approximately 0.05 acres), to permit a digital sign, all of which is described herein (Proposal No. 2015SP-104-001). The bill was disapproved by the Planning Commission. Mr. Elrod moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to AR2a zoning for properties located at 6950 Charlotte Pike and Cabot Drive (unnumbered), approximately 1,375 feet east of River Road (23.93 acres), all of which is described herein (Proposal No. 2016Z-013PR-001). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to SP zoning for properties located at 2034 and 2037 Pittway Drive and Oakwood Avenue (unnumbered), approximately 1,400 feet north of East Trinity Lane (20.61 acres), to permit a mixed-use development, all of which is described herein (Proposal No. 2016SP-016-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for property located at 1116 Sigler Street, approximately 100 feet east of 13th Avenue South (0.3 acres), to permit up to five residential units, all of which is described herein (Proposal No. 2016SP-009-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-173

A resolution accepting a grant from Oasis Center, Inc. to the Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, to provide support for the implementation of the Tennessee Wyman’s Teen Outreach Program as a part of probation services in order to decrease risky behaviors and increase life skills among youth involved in Juvenile Court. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-175

A resolution accepting a Tennessee Historical Commission Certified Local Government (CLG) Training Grant from the Tennessee Historical Commission to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Historical Commission, to provide continuing education for staff at the National Alliance of Preservation Commissions’ biannual Forum. The resolution was approved by the Budget and Finance and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-176

A resolution approving an intergovernmental agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department (hereinafter “MNPD”), and the U.S. Army Corps of Engineers for extra-duty police services. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-177

A resolution approving an intergovernmental agreement by and between the City of Goodlettsville, acting by and through the Goodlettsville Police Department, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, regarding law enforcement assistance. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-178

A resolution accepting a Homeland Security Grant from the State of Tennessee, Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Emergency Management, to fund costs related to Homeland Security Preparedness. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-179

A resolution to approve the third amendment to the lease agreement between The Metropolitan Government of Nashville and Davidson County and Greensboro I, L.P., extending the term and amending the rent and the auxiliary parking provisions for the Domestic Violence Program (Proposal No. 2016M-006PR-001). The resolution was approved by the Budget and Finance, Planning, Zoning, and Historical and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-180

A resolution accepting a Diversity in Action (DIA) Turns 20 Grant from the Association for Library Service to Children to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Public Library, to provide an outreach program in the Southeast Community to create successful diverse programming. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2016-184

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide public health activities to enhance the health and well-being of women, infants, and families by improving community resources and planning public health services.
The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-185

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish career services for eligible adults, youth, and dislocated workers with barriers to employment, education, training, and support services (LW09F161DSWLK16). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2016-186

A resolution approving Amendment Two to a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to establish career, training, and support services for adults (LW09F161ADULT16). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2016-187

A resolution approving an agreement between the United States Department of the Army and the Metropolitan Government of Nashville and Davidson County for Phase 5 of the Flood Preparedness Study in Davidson County, Tennessee. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2016-188

A resolution authorizing HOA Holdings, LLC to construct and install an aerial encroachment at 184 2nd Avenue North for (Proposal No.2015M-027EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-189

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Jermaine Sutton against the Metropolitan Government of Nashville and Davidson County and its employee, Richard Martin, in the amount of $45,000.00 and that said amount be paid out of the Judgments and Losses Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-190

A resolution setting the date and time for the State of the Metropolitan Government Address. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-191

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-192

A resolution supporting House Bill 2210 / Senate Bill 2410, as amended, currently pending in the Tennessee General Assembly, which would name the stables within the horse barn on the campus of the Ellington Agricultural Center the “Janis Sontany Stables.” The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-193

A resolution accepting a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for the Internet Crimes Against Children Unit. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2016-194

A resolution accepting a grant from the State of Tennessee, Department of Environment and Conservation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Public Works Department, for the operation and maintenance of a household hazardous waste collection site. The resolution was approved by the Budget and Finance and Public Works Committees.

- RESOLUTIONS -

RESOLUTION NO. RS2015-76

A resolution requesting the Metropolitan Board of Fair Commissioners to reinstate and continue to allow gun shows on Fairgrounds property and to otherwise comply with Section 11.602 of the Metropolitan Charter. The Codes, Fair, and Farmers Market Committee recommended indefinite deferment pursuant to Rule No. 23.

RESOLUTION NO. RS2016-172

A resolution appropriating to certain accounts for the benefit of the Metropolitan Nashville Police Department, State Trial Courts, Davidson County Election Commission, District Attorney, Public Defender, Municipal Auditorium, Board of Fair Commissioners, Nashville Farmers’ Market, Department of General Services, and Administrative Department Three Million Three Hundred Forty Seven Thousand Four Hundred Dollars ($3,347,400). The Budget and Finance Committee recommended deferment pursuant to Rule No. 23.

RESOLUTION NO. RS2016-174

A resolution declaring surplus and approving the disposition of certain parcels of real property in accordance with BL2015-45 and described below (Proposal No. 2016M-008PR-001). The Budget and Finance and Planning, Zoning, and Historical Committees recommended withdrawal. Mr. Pridemore moved to withdraw the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2016-181

A resolution approving a grant application to provide meals that meet RDA nutritional guidelines to eligible seniors throughout Davidson County from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission. RESOLUTION NO. RS2016-182

A resolution approving a grant application to provide transportation services to eligible seniors and handicapped residents in Davidson County from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.
