Metropolitan Council Meeting
Tuesday, March 7, 2000


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Rev. Freda Hall of the Wesley AME Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Ferrell, Waters, Briley, Gentry, Tucker, Gilmore, Black, Nollner, Majors, Hall, Beehan, Campbell, Dillard, Balthrop, Brown, Derryberry, Stanley, Loring, Greer, Hausser, Wallace, Haddox, Whitmore, Hand, Bogen, Summers, Shulman, Arriola, Sontany, Alexander, Holloway, Kerstetter, Knoch, Jenkins, Turner, Williams, Lineweaver, and President Steine (38); Absent: McClendon, Hart, Ponder (3).

The Minutes of the regular meeting of February 15, 2000 were approved.

- ELECTIONS AND CONFIRMATIONS -

Arts Commission

Appointment of Ms. Adelaide Vienneau to the Arts Commission. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electrical Examiners and Appeals Board

Reappointment of Mr. Gerald Grant to the Electrical Examiners and Appeals Board. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission

Appointment of Rabbi Randall Falk to the Human Relations Commission. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission

Reappointment of Mr. James Lawson and Ms. Ann Nielson to the Planning Commission. The Rules-Confirmations-Public Elections Committee recommended the appointments, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Zoning Appeals Board

Appointment of Ms. Ibba Surface to the Zoning Appeals Board. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Mr. Waters moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville and Eastern Rail Authority

The nomination of Councilman J.B. Loring to fill a one-year term on the Nashville and Eastern Rail Authority was announced. Mr. Waters, Chairman of the Rules-Confirmations-Public Elections Committee, reported that the Committee had considered and recommended the election of Mr. Loring to fill this seat. An election will be conducted by the Council at the meeting of March 21, 2000.

The President gave notice of a vacancy on the Cheatham County Rail Authority and announced that an election would be held by the Metropolitan Council to fill the two-year term. Deadline for nominations to be submitted in writing to the Metropolitan Clerk is March 14, 2000, at 4:00 p.m.; the election will be conducted by the Council at the first meeting in April.

A resolution approving the election of certain notaries public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee. Mr. Waters offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.36.040 by providing sunset provisions for Planned Unit Development Districts, all of which is more particularly described herein. Ms. Gilmore moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL99-124

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to RS20 District properties at 991 Morton Mill Road and Morton Mill Road (unnumbered), abutting the south margin of the CSX Railroad and the northern terminus of River Court (32.15 acres), (Proposal No. 99Z-108G), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Lineweaver requested a hearing from the public on this bill which had been previously advertised. The bill was disapproved by the Planning Commission. Mr. Briley, on behalf of the sponsor, moved to defer action on the bill to the public hearing in May, the bill being requested by Austin Daniel, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2000-157

The bill was approved by the Planning Commission. Mr. Loring requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard in favor of and in opposition to passage of the bill. BILL NO. BL2000-166

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling and amending a portion of the Commercial Planned Unit Development District located abutting the east margin of Pennington Bend Road, north of McGavock Pike, classified CA and proposed for AR2a (6.11 acres), to cancel the undeveloped Phase III approved for 204 multi-family units and amending the total number of multi-family units approved for Phases I and II to 396 units, (Proposal No. 94P-012U-14), all of which is more particularly described herein. The bill was approved by the Planning Commission. Mr. Loring requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill, and citizens were heard in favor of and in opposition to passage of the bill.
