ORDINANCE NO. BL2000-193
An ordinance abandoning a utility easement at 4441 Enchanted Circle and shown on Map 58-10 Parcel 33 measuring approximately 60 feet in length (2000M-021U-03).
Whereas, The Metropolitan Government of Nashville and Davidson County (the "Metropolitan Government") desires to relinquish any interest it may have in a certain a utility easement located in Nashville, Tennessee, and more particularly identified on Exhibit A attached hereto, to James Lawson; and
Now therefore, be it enacted by the Council of the Metropolitan Government of Nashville and Davidson County:
Section 1. The Metropolitan Government hereby relinquishes to James Lawson its right, title and interest in and to the utility easement area located on property map 58-10, part of parcel 33 and described on the map attached hereto as Exhibit A.
Section 2. Should any court of competent jurisdiction declare any section, clause, or provision of this ordinance to be unconstitutional, such decision shall affect only such section, clause or provision so declared unconstitutional, and shall not affect any other section, clause or provisions of this ordinance, it being the express intent of the Metropolitan County Council of The Metropolitan Government of Nashville and Davidson County that the remainder of this ordinance continue in full force and effect.
Section 3: This ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
