Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Marvin Neal, Pastor and Founder of The Canaan Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting of January 3, 2017 were approved.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Development and Housing Agency
Appointment of Ms. Emily Thaden for a term expiring November 5, 2021. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTIONS ON PUBLIC HEARING-

RESOLUTION NO. RS2017-518

A resolution exempting Marathon Music Works located at 1402 Clinton Street, from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. O’Connell requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2017-520

A resolution accepting a grant from the Community Foundation of Middle Tennessee to The Metropolitan Government of Nashville and Davidson County, acting by and through The Mayor’s Office of Economic Opportunity and Empowerment, to support the ongoing efforts of the Nashville Financial Empowerment Center. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-521

A resolution accepting a grant from the National Endowment for the Arts to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, to fund a series of temporary public art interventions, artist-led community planning, workshops focused on affordable housing and production spaces, and targeted creative economic neighborhood policies within Madison for cultural and economic redevelopment in the city. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2017-522

A resolution accepting a donation from WoodmenLife to the Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Police Department’s Mounted Patrol Unit. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-523

A resolution approving an intergovernmental agreement between the United States Department Marshals Service (USMS), and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to investigate and apprehend local, state, and federal fugitives. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-524

A resolution accepting a grant from ExxonMobil Refining and Supply to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Fire Department, to support efforts to upgrade emergency response equipment and offer training opportunities. The resolution was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees.

RESOLUTION NO. RS2017-525

A resolution accepting a Proctor Family Barn Grant from the Friends of Beaman Park to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for the rehabilitation of the Proctor Family Barn located in Beaman Park. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-526

A resolution accepting a Proctor Family Barn Grant from Mary Proctor O’Neil to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for the rehabilitation of the Proctor Family Barn located in Beaman Park. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-527

A resolution accepting a Proctor Family Barn Grant from Greenways for Nashville to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for the rehabilitation of the Proctor Family Barn located in Beaman Park. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-528

A resolution approving an application for a Big Band Dances Grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks and Recreation Department. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-529

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for one employee’s salary to provide administrative support at Two Rivers Mansion. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-530

A resolution accepting a Friends of Centennial Park and Parthenon Grant from The Conservancy for the Parthenon and Centennial Park to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for one employee’s salary. The resolution was approved by the Budget and Finance and Parks, Library, and Recreation Committees.

RESOLUTION NO. RS2017-531

A resolution approving Amendment Three to a contract with Vanderbilt University Medical Center and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to participate as a member site in the Centers for Disease Control Tuberculosis Epidemiologic Studies Consortium studies. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2017-532

A resolution to amend Ordinance No. BL2016-317 to abandon an existing fire hydrant and appurtenances for property located at 900 Rosa L. Parks Boulevard (MWS Project No. 16-WL-0007 and Proposal No. 2017M-002ES-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.

RESOLUTION NO. RS2017-533

A resolution recognizing William P. Sinclair, Executive Director of Catholic Charities of Tennessee, on the occasion of his retirement. The resolution was approved by the Rules, Confirmation, and Public Elections Committee.

RESOLUTION NO. RS2017-534

A resolution recognizing Tommy Lynch recipient of the 2016 Tennessee Recreation and Parks Association Fellow Award. The resolution was approved by the Parks, Library, and Recreation Committee.

RESOLUTION NO. RS2017-519

A resolution approving a contract between The Metropolitan Government of Nashville and Davidson County and Host Compliance, LLC, to provide services related to short term rental permitting and tax collection. The resolution was approved by the Budget and Finance Committee; the Codes, Fair, and Farmers Market, Convention, Tourism, and Public Entertainment Facilities, and Planning, Zoning, and Historical Committees recommended deferment. Pursuant to Rule 24, this resolution was deferred.

An Ordinance amending Metropolitan Code of Laws Section 2.222.010(2)(o) regarding exemptions of items constituting “Anything of value”, and further amending Section 2.222.030 regarding annual benefit reporting statements disclosures. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2017-561

An ordinance amending section 12.40.040 of the Metropolitan Code of Laws regarding prohibited locations for stopping, standing and parking vehicles. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair, and Farmers Market and Public Safety, Beer, and Regulated Beverages Committees by a voice vote of the Council.

BILL NO. BL2017-562

An ordinance approving the First Amendment to the Lease Agreement by and between the Metropolitan Government of Nashville and Davidson County and Steven M. Minton and Elaine Minton (Proposal No. 2017M-001PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Planning, Zoning, and Historical, and Public Safety, Beer, and Regulated Beverages Committees by a voice vote of the Council.

BILL NO. BL2017-563

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to adopt the revised Flood Insurance Rate Map to minimize dangers to life and property, due to flooding, and to maintain eligibility for participation in the National Flood Insurance Program (Proposal No. 2017M-002OT-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-564

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County to accept a donation of $25,000 from Craighead Development LLC to aid in the construction of intersection improvements at SR171, Hobson Pike and Pin Hook Road (Project No. 2016-R-43). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-565

An ordinance approving a participation agreement between the Metropolitan Government and Century Farms LLC, for the construction of public infrastructure improvements, phases PE-N and PE-D (Proposal No. 2017M-004PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning and Public Works Committees by a voice vote of the Council.

BILL NO. BL2017-566

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and any associated easements and to accept new sewer and water main, any associated easements, and manholes for properties located at 306-B, 306, 402, 408, 500, and 0 Cowan Street (MWS Project Nos. 15-SL-113, 15-WL-84 and Proposal No. 2017M-003ES-001). The bill was approved by the Planning Commission. BILL NO. BL2017-568

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sanitary sewer main and easement and to accept a new sanitary sewer main and easement, and sanitary sewer manholes, for properties located at 415 27th Avenue North and 512 26th Avenue North (MWS Project No. 16-SL-197 and Proposal No. 2017M-005ES-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Collier Avenue Stormwater Improvement Project for 10 properties located along Collier Avenue and Tanksley Avenue, (Project No. 17-SWC-131 and Proposal No. 2017M-009ES-001). The bill was approved by the Planning Commission. An ordinance adopting the Geographic Information Systems Street and Alley Centerline Layer, with the recordation of renaming, additions and deletions of acceptances and abandonments as reflected on the Centerline Layer to date, as the Official Street and Alley Acceptance and Maintenance Record for the Metropolitan Government of Nashville and Davidson County (Proposal Number 2017M-001OT-001). The bill was approved by the Planning Commission. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending a Planned Unit Development Overlay District on a portion of property located at 1031 Barnes Road and Barnes Road (unnumbered), approximately 130 feet west of Blackpool Drive, zoned AR2a and partially within a Planned Unit Development Overlay District (2.9 acres), to permit the addition of 2.9 acres, all of which is described herein (Proposal No. 2005P-003-002). An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS10 zoning on a portion of property located at 1031 Barnes Road, approximately 220 feet west of Blackpool Drive, (2.9 acres), all of which is described herein (Proposal No. 2016Z-133PR-001). The bill was approved by the Planning Commission. BILL NO. BL2017-577

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to MHP zoning for a portion of property located at 1343 Dickerson Pike, west of the terminus of Hillcrest Road, (14.12 acres), all of which is described herein (Proposal No. 2016Z-101PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2017-578

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Historical Landmark Overlay District on property located at 10604 Concord Road, approximately 600 feet southwest of Nolensville Pike, zoned AR2a (3.11 acres), all of which is described herein (Proposal No. 2017HL-001-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2017-579

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing RS5 to SP zoning for property located at 2805, 2807, 2809, and 2811 Delaware Avenue, approximately 175 feet north of Felicia Street (0.68 acres) to permit up to 16 residential units, all of which is described herein (Proposal No. 2016SP-066-001). The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

- BILLS ON SECOND READING -

BILL NO. BL2016-461

An ordinance to amend Title 2 of the Metropolitan Code of Laws to require employees of the Metropolitan Government of Nashville and Davidson County to report fraud and unlawful acts committed against the Metropolitan Government. The Rules, Confirmations, and Public Elections Committee recommended indefinite deferment at the request of the sponsor. Mr. Shulman moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-473

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Hillwood Court at Nashville West Specific Plan District for property located at 6813 B and 6817 Charlotte Pike, approximately 640 feet southwest of West Hillwood Drive, (4.37 acres), to add parcel 015 permit and permit a maximum of 50 residential units where 34 residential units were previously approved, all of which is described herein (Proposal No. 2013SP-048-003). The bill was approved by the Planning Commission with conditions, disapproved without. The Planning, Zoning, and Historical Committee recommended deferment. Ms. Mina Johnson moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-497

An ordinance amending Section 12.40.090 of the Metropolitan Code to provide guidance for placement of handicapped parking spaces on public streets outside residential properties. The bill was approved by the Public Works and Traffic, Parking, and Transportation Committees. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-498

An ordinance to amend Chapter 13.20 of the Metropolitan Code to require approval by the Metropolitan Council for obstructions or excavations which close or occupy any portion of the public right of way for a period in excess of one (1) year. The Public Works Committee recommended deferment. Mr. Elrod moved to defer the bill to the first meeting in April, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-500

An ordinance authorizing the acquisition of certain easements and property rights by negotiation or condemnation for use in public projects of the Metropolitan Government, initially for purposes of Public Works Department Project Number 2015-R-026, Willow Branch Drive Sidewalk Improvements (Proposal No. 2016M-031ES-001). The bill was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical, and Public Works Committees. Ms. Karen Johnson moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-525

An ordinance amending chapter 2.44 of the Metropolitan Code of Laws to require the Metropolitan Police Department to provide reports of positive engagements with the community to the Metropolitan Council. The motion to recommend approval of the bill failed by the Public Safety, Beer, and Regulated Beverages Committee. Mr. Shulman moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-526

An ordinance amending section 4.48.030 of the Metropolitan Code of Laws regarding confidential information. The bill was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-531

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County, by changing the name of a Lifeway Plaza to “J M Frost Plaza” (Proposal Number 2017M-001SR-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, Public Works, and Traffic, Parking, and Transportation Committees. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by changing the name of a portion of Jo Johnston Avenue to “Lifeway Plaza” (Proposal Number 2017M-002SR-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, Public Works, and Traffic, Parking, and Transportation Committees. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County, by changing the name of a portion of Boscobel Street to “North 6th Street” (Proposal Number 2017M-003SR-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, Public Works, and Traffic, Parking, and Transportation Committees. Mr. Withers moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-541

An ordinance amending section 2.20.130 of the Metropolitan Code of Laws regarding appointment of special advisory committees to propose persons to serve as administrative hearings officers. The bill was approved by the Codes, Fair, and Farmers Market and Rules, Confirmation, and Public Elections Committees. Ms. Karen Johnson moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2017-542

An ordinance amending Chapter 4.12 of the Metropolitan Code to require contracts for correctional facility management services to be approved by the Metropolitan Council and to include a requirement that reports be submitted to the Metropolitan Council regarding contractor performance. The bill was approved by the Budget and Finance and Public Safety, Beer, and Regulated Beverages Committees. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council with Mr. Withers abstaining.
