RESOLUTION NO. RS2017-532

A resolution to amend Ordinance No. BL2016-317 to abandon an existing fire hydrant and appurtenances for property located at 900 Rosa L. Parks Boulevard (MWS Project No. 16-WL-0007 and Proposal No. 2017M-002ES-001).

WHEREAS, Ordinance No. BL2016-317, approved August 3, 2016, authorized the abandonment and acceptance of said water mains, fire hydrant assembly, sewer mains, six manholes, appurtenances, and easements for construction of project numbers 16-WL-0007 and 16-SL-0012; and,

WHEREAS, an additional fire hydrant needs to be abandoned on a parcel located at 900 Rosa L. Parks Boulevard for construction of project number 16-WL-0007; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2017M-002ES-001 on November 28, 2016, for the abandonment of said fire hydrant and appurtenances; and,

WHEREAS, Ordinance No. BL2016-317 provides that amendments shall be approved by resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That Ordinance No. BL2016-317 is hereby amended to abandon an existing fire hydrant located at 900 Rosa L. Parks Boulevard, and appurtenances for construction of project number 16-WL-0007, as listed below and shown on Exhibit 1 which is attached hereto and incorporated by reference:

Section 2, The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the acquisition authorized by the ordinance.

Section 3. That the resolution shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
