The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Robert Swope.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Metropolitan Nashville Arts Commission
Appointment of Ms. Nicolette Coffman for a term expiring January 1, 2020. The Rules, Confirmations, and Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Reappointment of Ms. Phyllis D.K. Hildreth for a term expiring February 19, 2019. The Rules, Confirmations, and Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTION ON PUBLIC HEARING -

RESOLUTION NO. RS2016-131

A resolution exempting Steadfast Fine Coffee located at 1329 Sixth Avenue North, Nashville, TN 37208 from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. Mr. Pardue requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-115

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to participate in the Incumbent Worker Training Program to establish career and support services (LW09F161IWSWA16). The resolution was approved by the Budget and Finance and Personnel, Public Information, Human Relations, and Housing Committees.

RESOLUTION NO. RS2016-116

A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to purchase and up-fit a van for use as a mobile office for the provision of women, infants, and children (WIC) services. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-117

A resolution accepting a grant from the Center for Nonprofit Management to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to benefit the Hospital to Home Program. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-118

A resolution accepting a grant from Boulevard Bolt, Inc. to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to benefit the How’s Nashville program to aid homelessness. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-119

A resolution appropriating funds from the United States Department of Health and Human Services to the Metropolitan Action Commission to support the Head Start Program by funding a comprehensive child development program. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-120

A resolution approving Amendment Three to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund an ongoing program to protect air quality to achieve established ambient air standards and protect human health. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-121

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide public health activities to enhance the health and well-being of women, infants, and families by improving community resources and planning public health services. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-122

A resolution approving Amendment One to a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to support the delivery of public health services. The resolution was approved by the Budget and Finance and Health, Hospitals, and Social Services Committees.

RESOLUTION NO. RS2016-123

A resolution approving an agreement between the State of Tennessee, by and through Austin Peay State University Department of Social Work, and the Metropolitan Government of Nashville and Davidson County, by and through the Juvenile Court, for a field instruction program for the professional education of social work students. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-124

A resolution approving a cooperative agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and TriStar Centennial Medical Center to provide a Worksite POD for licensed medical employees and other licensed medical professionals specified by TriStar Centennial Medical Center with mass prophylaxis for distribution in the event of a public health emergency. The resolution was approved by the Health, Hospitals, and Social Services Committee.

RESOLUTION NO. RS2016-125

A resolution authorizing The Escape Game, LLC to construct and install an aerial encroachment at 162 3rd Avenue North (Proposal No. 2016M-004EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-126

A resolution authorizing Martin’s BBQ Joint to construct and install an aerial encroachment at 410 4th Avenue South (Proposal No.2016M-006EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees.

RESOLUTION NO. RS2016-128

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Annie M. Barbee against the Metropolitan Government of Nashville and Davidson County in the amount of $200,000.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-129

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Christopher L. Foster against the Metropolitan Government of Nashville and Davidson County in the amount of $19,000.00 and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-130

A resolution recognizing Norman Buck Dozier, Jr., for his many years of service to the Metropolitan Government. The resolution was approved by the Rules, Confirmations, and Public Elections Committee.

RESOLUTION NO. RS2016-127

A resolution authorizing Nashville Baseball Development, LLC, c/o Spectrum Properties to construct and install an aerial encroachment at Stockyard Street between 2nd Avenue North and 3rd Avenue North for an elevated pedestrian bridge across Whiteside Avenue (Proposal No.2015M-029EN-001). The resolution was approved by the Planning Commission and Planning, Zoning, and Historical Committee. The Public Works Committee recommended deferment. Mr. Pridemore moved to defer the resolution, which motion was seconded and approved by a voice vote of the Council.

Without objection, the rules were suspended for consideration of one (1) late resolution.

RESOLUTION NO. RS2016-132

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support the necessary legislation to require countywide satellite locations for early voting. Mr. Bedne moved to adopt the resolution, which motion was seconded. Mr. Glover requested a suspension of the rules to allow an amendment to be heard and no objection was made. Mr. Glover offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. An ordinance amending the application requirements of Section 6.75 of the Metropolitan Code of Law, Pedicabs and Pedal Carriages. BILL NO. BL2016-149

An ordinance authorizing the Metropolitan Government to enter a participation agreement for the construction of public infrastructure improvements and to accept a donation of real property for park purposes in the North Gulch area (Proposal No. 2016M-007PR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Parks, Library, and Recreation and Planning, Zoning, and Historical Committees by a voice vote of the Council.

BILL NO. BL2016-150

An ordinance authorizing the Director of Public Property Administration to execute a quitclaim deed for any property interests the Metropolitan Government may have in a portion of the right-of-way of Korean Veterans Boulevard, and accepting consideration for same in the amount of $277,000.00 (Proposal No. 2016M-003AB-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-151

An ordinance approving a Lease Agreement by and between The Metropolitan Government of Nashville and Davidson County and the State of Tennessee, and a Sublease Agreement by and between The Metropolitan Government of Nashville and Davidson County and STEM Preparatory Academy (Proposal No. 2016M-002PR-001). The bill was approved by the Planning Commission. BILL NO. BL2016-153

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS15 zoning for property located at 900 Old Lebanon Dirt Road, at the northeast corner of Old Lebanon Dirt Road and North New Hope Road (0.47 acres), all of which is described herein (Proposal No. 2015Z-093PR-001). The bill was approved by the Planning Commission. An ordinance amending Chapter 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the waiver of a Traffic Impact Study (Proposal No. 2016Z-005TX-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-156

An ordinance recognizing the establishment of application and fee requirements promulgated by the Davidson County Clerk for motor vehicle race track licensure in Nashville and Davidson County, Tennessee. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Codes, Fair, and Farmers Market Committees by a voice vote of the Council.

BILL NO. BL2016-99

An ordinance amending Chapter 2.132 of the Metropolitan Code of Laws by eliminating the term limits of members of the Metropolitan Human Relations Commission. Ms. Murphy offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2016-99

An ordinance amending Chapter 2.132 of the Metropolitan Code by modifying the term limit provisions of members of the Metropolitan Human Relations Commission. The bill was approved by the Personnel, Public Information, Human Relations, and Housing Committee. Ms. Murphy moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-123

An ordinance approving Amendment No. 8 to the Rutledge Hill Redevelopment Plan. The Budget and Finance Committee recommended deferment. Mr. Mendes moved to defer the bill to the second meeting in April, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-124

An ordinance abolishing the Metropolitan Government’s vegetation control board, created by enactment of Ordinance No. 093-884, by repealing Chapter 10.28 and Section 2.104.080 of the Metropolitan Code of Laws. The bill was approved by the Codes, Fair, and Farmers Market Committee. Mr. Coleman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-125

An ordinance amending Section 16.33.140 of the Metropolitan Code of Laws to designate additional geographic areas as rental inspection districts (Proposal Nos. 2016M-002OT-001, and 2016M-003OT-001). The bill was approved by the Planning Commission, Codes, Fair, and Farmers Market, and the Planning, Zoning, and Historical Committee. Ms. Karen Johnson moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-126

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for the Metropolitan Government of Nashville and Davidson County and specifically with relation to the expansion of the Martin Luther King Junior Academic Magnet for the use and benefit of the Metropolitan Nashville Public Schools (Proposal No. 2016M-001PR-001). The bill was approved by the Planning Commission, Budget and Finance, Education and Planning, Zoning, and Historical Committees. An ordinance authorizing the disposition of surplus property and the licensing of that property for temporary use pending its disposition (Proposal No. 2016M-003PR-001). An ordinance authorizing the exchange of surplus property for acquiring additional land to be used for the Public Works Department’s Division Street Extension Project (Proposal No. 2016M-004PR-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent and temporary easements through negotiation, condemnation, or fee simple take to construct the Davidson Branch Equalization Facility for property located at 6924 Charlotte Pike (Project No. 11-SC-111 OAP and Proposal No. 2016M-001ES-001). The bill was approved by the Planning Commission, Budget and Finance, Planning, Zoning, and Historical and Public Works Committees. Mr. Rosenberg moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-130

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing water main and to accept a new water main, fire hydrant, and permanent easements for property located at 101 Terminal Court (MWS Project No. 15-WL-128 and Proposal No. 2016M-003ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical and Public Works Committees. An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of Korean Veterans Boulevard (former Franklin Street) right-of-way (Proposal Number 2016M-002AB-001). The bill was approved by the Planning Commission, Traffic and Parking Commission, Planning, Zoning, and Historical, Public Works and Traffic, Parking and Transportation Committees. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 and R20 to SP for properties located at 326 Old Hickory Boulevard, Old Hickory Boulevard (unnumbered) and Highway 70 (unnumbered), on the east side of Old Hickory Boulevard and north of Highway 70 (approximately 246 acres), to permit the additional disturbance of the natural landscape to a maximum of 14 acres to permit up to 360 multi-family residential units, all of which is described herein (Proposal No. 2015SP-113-001). Ms. Mina Johnson offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.
