Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Jason Potts.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Garrett, Tygard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Bennett, Hagar, Glover, Stites, Stanley, Claiborne, Tenpenny, Allen, Gilmore, Baker, Langster, Weiner, Evans, Holleman, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Duvall, Todd, Mitchell and Neighbors (34); Absent: Steine, Maynard, Anthony Davis, Pridemore, Pardue, Moore, McGuire (7).

The Minutes of the regular meeting of November 4, 2014, were approved.

- PROPOSED RULES AMENDMENT -

23. Deferrals; excessive deferrals; indefinite deferrals

Rule 23 of the 2011-2015 Rules of Procedure of the Council, as amended, be further amended by deleting the third paragraph in its entirety and substituting with the following:

“Any ordinance or resolution that has been deferred indefinitely for a period of more than ninety (90) days shall automatically be deferred for one meeting upon being placed back on the agenda at the request of the sponsor pursuant to this rule and shall be re-referred to the appropriate committee(s) selected by the Vice Mayor for a recommendation.”

The Rules-Confirmations-Public Elections Committee recommended approval. - ELECTIONS AND CONFIRMATIONS -

Community Corrections Advisory Board
Appointment of Mr. Michael Jones for a term expiring August 31, 2015. Mr. Jones will fill the unexpired term of Mr. Vince Wyatt. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Development & Housing Agency
Reappointment of Ms. Anna Page for a term expiring November 5, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education, Community & Arts Television Corp (NECAT)
Appointment of Mr. Mark Rowan for a term expiring February 5, 2016. Mr. Rowan will fill the unexpired term of Mr. Keith Miles. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- RESOLUTIONS ON PUBLIC HEARING -

RESOLUTION NO. RS2014-1287

A resolution exempting Bier Fest located at 117 28th Avenue North from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Ms. Langster requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. The Public Safety-Beer and Regulated Beverages Committee recommended deferment. Ms. Langster requested a suspension of the rules to allow the resolution to be heard and no objection was made. RESOLUTION NO. RS2014-1288

A resolution exempting Butchertown Hall located at 1416 Fourth Avenue North from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1290

A resolution approving an application for the 2014 Homeland Security Grant from the State of Tennessee, Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1291

A resolution accepting a grant from the State of Tennessee, Department of Transportation, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for the continuance of the enhanced DUI enforcement initiative to reduce traffic fatalities attributed to impaired drivers through aggressive enforcement.
The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1292

A resolution approving a clinical affiliation agreement between the State of Tennessee, by and through Motlow State Community College, and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Fire Department (“NFD”), for the participation and clinical training of students enrolled in the Emergency Medical Services program. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee.

RESOLUTION NO. RS2014-1293

A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department (“MNPD”), and the State of Tennessee, acting by and through the Department of General Services, to use space inside the MNPD West Precinct as a State of Tennessee Driver’s License Kiosk facility (Proposal No. 2014M-030PR-001). The resolution was approved by the Planning Commission, Public Safety-Beer and Regulated Beverages and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1294

A resolution approving a contract for services by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and United Neighborhood Health Services to provide homeless individuals with medical services at two or more clinics in or near downtown Nashville. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1295

A resolution approving a voluntary paternity acknowledgment provider agreement by and between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, and the State of Tennessee, Department of Human Services, for fathers voluntarily seeking to acknowledge their paternity. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1296

A resolution authorizing Powell Construction Studio, LLC, to construct and install an aerial encroachment at 904 Main Street (Proposal No. 2014M-019EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

RESOLUTION NO. RS2014-1297

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1298

A resolution honoring Mr. John Hoomes on his 20th Anniversary as Artistic Director of Nashville Opera. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1299

A resolution recognizing local Davidson County small businesses and merchants and proclaiming Saturday, November 29, 2014, as Small Business Saturday. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1289

A resolution authorizing an economic and community development incentive grant to be made to the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County for the benefit of Bridgestone Americas, Inc. and its affiliates. The Budget and Finance Committee recommended deferral. Ms. Gilmore moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-1300

A resolution supporting efforts to reduce greenhouse gas emissions and supporting President Obama’s Clean Power Plan to reduce carbon pollution from power plants. The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Westerholm moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

An ordinance approving Amendment No.3 to the Five Points Redevelopment Plan (Proposal No. 2014M-005OT-001).

BILL NO. BL2014-949

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to R6 for properties located at 1103 and 1105 Holly Street, approximately 60 feet east of South 11th Street and located within the Lockeland Springs-East End Neighborhood Conservation Overlay and the Five Points Redevelopment District (0.42 Acres), all of which is described herein (Proposal No. 2014Z-065PR-001).

BILL NO. BL2014-950

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 to R6 for properties located at 1101 and 1103 Shelby Avenue, at the northeast corner of Shelby Avenue and South 11th Street and located within the Lockeland Springs-East End Neighborhood Conservation Overlay and the Five Points Redevelopment District (0.36 Acres), all of which is described herein (Proposal No. 2014Z-066PR-001).

Mr. Westerholm moved to pass the bills on first reading, refer the bills to the Planning Commission and Planning, Zoning and Historical Committee and defer the bills to the February public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-951

An ordinance to amend Chapter 6.28 of the Metropolitan Code pertaining to Short Term Rental Property. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market, and Convention, Tourism and Public Entertainment Facilities Committees by a voice vote of the Council.

BILL NO. BL2014-952

An ordinance amending Chapter 6.74 of the Metropolitan Code of Laws to regulate motorized, non-taxi passenger vehicles for hire, including, but not limited to, Transportation Network Companies. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Public Works and Traffic, Parking and Transportation Committees by a voice vote of the Council.

BILL NO. BL2014-953

An ordinance authorizing the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County to negotiate and accept payments in lieu of ad valorem taxes with respect to Highwoods Realty Limited Partnership (the Project Developer), Bridgestone Americas, Inc. and certain affiliates of Bridgestone Americas, Inc. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

An ordinance approving an agreement between the Metropolitan Government and Live Nation Worldwide, Inc. (“Live Nation”) relating to management of the West Riverfront Amphitheater currently under construction. An ordinance approving an exchange of real property interests between the Metropolitan Government and MFP Real Estate LLC for construction of a minor league baseball stadium and related improvements (Proposal No. 2614M-029PR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Convention, Tourism and Public Entertainment Facilities, and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-956

An ordinance authorizing acceptance of easements from the State of Tennessee for public right-of-way and greenway maintenance purposes in connection with development of the new minor league baseball park in the area known as Sulphur Dell (Proposal No. 2014M-076ES-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-957

An ordinance authorizing the Director of Public Property, or his designee, to accept and record the attached quitclaim deed from the Metropolitan Development and Housing Agency conveying to The Metropolitan Government a tract of land located at the southeast quadrant of the intersection of Korean Veterans Boulevard and 1st Avenue South (or Hermitage Avenue) (Proposal No. 2014M-023PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-958

An ordinance approving and authorizing the Director of Public Property, or his designee, to accept the donation of real property (known as Map 059-16 Parcel 248.00) from Harding Corporation, for use as part of the parks system (Proposal No. 2014M-020PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Parks, Library and Recreation and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-959

An ordinance authorizing the Director of Public Property Administration, or his designee, to accept, execute and record a quitclaim deed from the Friends of The Warner Parks, Inc., to The Metropolitan Government of Nashville and Davidson County for a certain parcel of property located on Highway 100 for use as part of the public park system but excluding a 5.01 acre tract and granting an easement for ingress and egress across said tract (Proposal No. 2014M-028PR-00). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Parks, Library and Recreation and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-960

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, to enter into an agreement with Cumberland River Compact (“CRC”), to continue to fund initiatives established as the result of the Consent Decree with the Department of Justice of the United States and The State of Tennessee. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

An ordinance approving an agreement granting CSX Transportation, Inc., access to the 800-MHZ system for public safety purposes. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees by a voice vote of the Council.

BILL NO. BL2014-962

An ordinance authorizing Renasant Bank to install, construct and maintain an underground encroachment for an irrigation line to serve plantings along 19th Avenue North that are located within the right-of-way at 1820 West End Avenue (Proposal No. 2014M-018EN-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-925

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to regulate the commercial use of pedicab and pedal carriages within certain portions of Nashville and Davidson County, and to amend Title 6 of the Metropolitan Code to provide for such regulations. The Budget and Finance, Convention, Tourism and Public Entertainment Facilities, Public Works and Traffic, Parking and Transportation Committees recommended deferment. Ms. Allen moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-926

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County (“Metro”), acting by and through the Metropolitan Department of Water and Sewerage Services (“Metro Water Services”), to subsidize the cost of rain barrels for the residents of the Metropolitan Government of Nashville and Davidson County. The bill was approved by the Budget and Finance
and Public Works Committees. Ms. Bennett moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-927

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County, by naming the private road accessing the Harpeth Trace Condominiums “Harpeth Trace Summit” from Harpeth Trace Drive eastwardly to its terminus (Proposal No. 2014M-002SR-001). The bill was approved by the Planning Commission and Traffic, Parking and Transportation Committee. The Public Works and Planning, Zoning and Historical Committees recommended deferment. Ms. Evans requested a suspension of the rules to allow the bill to be heard and objections were made. Pursuant to Rule No. 24, the bill was deferred.

BILL NO. BL2014-928

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Bell Road Stormwater Improvement Project for two properties located at 550 and 554 Bell Road (MWS Project No. 15-SWC-024 and Proposal No. 2014M-061ES-001).The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committee. Ms. Dowell moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-929

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Tuckahoe Drive Stormwater Improvement Project for four properties located at 602, 603, and 605 Tuckahoe Drive and 114 Rhine Drive (Project No. 15-SWC-030 and Proposal No. 2014M-056ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committee. Ms. Bennett moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-930

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the County Hospital Road Stormwater Improvement Project for various properties located along County Hospital Road, Doak Avenue, and Manchester Avenue (Project No. 15-SWC-034 and Proposal No. 2014M-052ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Harrison moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-931

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Wildwood Drive Stormwater Improvement Project for 13 properties located along Rural Hill Road, Rural Hill Circle and Wildwood Drive (Project No. 14-SWC-18 and Proposal No. 2014M-057ES-001). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee; the Public Works Committee approved the bill with an amendment. Ms. Johnson offered Amendment No. 1, correcting Project No. 14-SWC-158 as outlined in the caption, and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Ms. Johnson moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-932

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Cornwall Drive Stormwater Improvement Project for three properties located at 6517 and 6525 Brownlee Drive and 6541 Cornwall Drive (Project No. 15-SWC-033 and Proposal No. 2014M-055ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Evans moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-933

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Kenner Avenue Stormwater Improvement Project for nine properties located along Kenner Avenue and Ensworth Place (Project No. 15-SWC-027 and Proposal No. 2014M-060ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Hunt moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-881

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to RM20-A zoning for property located at 1223 N. 6th Street, at the southeast corner of N. 6th Street and Douglas Avenue (0.20 acres), all of which is described herein (Proposal No. 2014Z-047PR-001). The bill was approved by the Planning Commission and the Planning, Zoning and Historical Committees Mr. Scott Davis moved to defer the bill to the second meeting in December, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-896

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning for various properties located along Arrington Street, Berry Street, Cleveland Street, Douglas Avenue, Evanston Avenue, Joseph Street, Lischey Avenue, Meridian Street, Montgomery Avenue, N. 2nd Street, N. 5th Street, N. 6th Street, N. 7th Street, N. 8th Street, Pennock Avenue, Richardson Avenue, Stainback Avenue, Stockell Street, Treutland Avenue, Vaughn Street and Vernon Winfrey Avenue, south of Douglas Avenue (238.26 acres), to allow detached accessory dwelling units with all other standards of the RS5 district being applicable, all of which is described herein (Proposal No. 2014SP-076-001). The bill was approved by the Planning Commission with conditions, disapproved without.
The Planning, Zoning and Historical Committee recommended deferment. Mr. Scott Davis moved to defer the bill to the second meeting in December, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-897

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 to RS10 zoning for various properties located along Auburn Lane, Dartmouth Avenue, Tulane Court and Woodmont Lane, south of Woodmont Boulevard (approximately 23.87 acres), all of which is described herein (Proposal No. 2014Z-054PR-001). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Todd moved to defer the bill to the second meeting in December, which motion was seconded and adopted by a voice vote of the Council.

Without objection, Bill Nos. BL2014-898 and BL2014-899 were considered together.
