ORDINANCE NO. BL2014-926

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County (“Metro”), acting by and through the Metropolitan Department of Water and Sewerage Services (“Metro Water Services”), to subsidize the cost of rain barrels for the residents of The Metropolitan Government of Nashville and Davidson County.

WHEREAS, the Tennessee Department of Environment and Conservation issued Metro a Municipal Separate Storm Sewer System (MS4) National Pollutant Discharge Elimination System (NPDES) permit under the authority of the Tennessee Water Quality Control Act of 1977 (T.C.A 69-3-101 et seq.) and the delegation of authority from the United States Environmental Protection Agency under the Federal Water Pollution Control Act, as amended by the Clean Water Act of 1977 (33 U.S.C. 1251, et seq.); and,

WHEREAS, Metro Water Services manages Metro’s MS4 NPDES permit, which requires a public education and outreach program that focuses on impacts of stormwater discharges to water bodies and the steps that the public can take to reduce pollutants in stormwater runoff; and,

WHEREAS, the installation of rain barrels can reduce stormwater runoff to Metro’s streams and combined sewer system; and,

WHEREAS, a rain barrel outreach program is an effective tool to educate the public about stormwater runoff and water conservation: and,

WHEREAS, through a competitive bid process, Metro Water Services will select a company to manage a subsidized rain barrel program and will pay $20 of the cost of the first 1,000 rain barrels sold through the program ($20,000); and,

WHEREAS, it is in the best interests of The Metropolitan Government of Nashville and Davidson County to enter into the subsidized rain barrel program.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County (“Metro”), acting by and through the Metropolitan Department of Water and Sewerage Services (“Metro Water Services”), is hereby authorized to subsidize the cost of rain barrels for the residents of the Metropolitan Government of Nashville and Davidson County.

Section 2 The Director of the Metropolitan Department of Water and Sewerage Services is authorized to implement said program and to execute any related documents.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
