The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilmember Sean McGuire.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Agricultural Extension Board
Reappointment of Mr. Dan Covington for a term expiring August 1, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Mark Kerske for a term expiring August 1, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Corrections Advisory Board
Appointment of Ms. Grace Guerra for a term expiring August 31, 2016. Ms. Guerra will fill the Metropolitan Government employee position. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Bettie Kirkland for a term expiring August 31, 2016. Ms. Kirkland will fill the non-profit position. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission
Reappointment of Mr. F. Clay Bailey for a term expiring August 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Lula Brooks for a term expiring August 10, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Jim Hoobler for a term expiring August 10, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Linda Wynn for a term expiring August 10, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Property Standards and Appeals Board
Appointment of Mr. J. R. Herrell for a term expiring July 29, 2016. Mr. Herrell will fill the unexpired term of Mr. David Glasgow. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Harmon moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

BILL NO. BL2013-392

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to RS80 zoning for property located at Sawyer Brown Road (unnumbered), approximately 540 feet north of Meadow Lane Drive (39.09 acres), all of which is described herein (Proposal No. 2013Z-008PR-001). Ms. Weiner requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Weiner moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-853

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R10 and OL to SP zoning for a portion of property located at 410 Donelson Pike, at the northwest corner of Lakeland Drive and Donelson Pike (2.04 Acres), to permit up to 15 residential units, all of which is described herein (Proposal No. 2014SP-045-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Claiborne requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Claiborne moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-854

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for property located at 404 South 16th Street, at the southwest corner of South 16th Street and Boscobel Street (0.14 Acres), to permit three detached units, all of which is described herein (Proposal No. 2014SP-049-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Westerholm requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to SP zoning for property located at 4214 Central Pike, at the southeast corner of South New Hope Road and Central Pike (15.4 Acres), to permit a mixture of uses, all of which is described herein (Proposal No. 2014SP-050-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Glover requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Glover moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council with Mr. Hagar abstaining.

BILL NO. BL2014-856

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R40 to SP zoning for property located at 7295 Sonya Drive, approximately 1,360 feet north of Old Hickory Boulevard (1.83 Acres), to permit up to 16 residential dwelling units, all of which is described herein (Proposal No. 2014SP-043-001). The bill was approved by the Planning Commission with conditions, disapproved without.

BILL NO. BL2014-857

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUL-A zoning for property located at 800 44th Avenue North, approximately 140 feet south of Illinois Avenue (1.66 acres), all of which is described herein (Proposal No. 2014Z-048PR-001).
Mr. Baker moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-858

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to SP zoning for property located at Bell Road (unnumbered), approximately 200 feet south of Eagle View Boulevard, (0.9 acres), to permit a restaurant, all of which is described herein (Proposal No. 2014SP-038-001). The bill was approved by the Planning Commission with conditions, disapproved without. Ms. Dowell requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Dowell moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

Without objection, BL2015-859 was moved to the heel of the agenda at this time.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-1205

A resolution accepting the Edward Byrne Memorial Justice Assistance Grant (JAG) from the United States Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, for technology upgrades, supplies for direct support to basic police, in-service, and specialized training. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1206

A resolution approving an interlocal agreement between the Emergency Communications District for Nashville and Davidson County and The Metropolitan Government of Nashville and Davidson County for provision of services and reimbursement of costs pertaining to Enhanced-911 services. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-1207

A resolution approving an internship affiliation agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, and the University of Tennessee College of Social Work, to provide field and internship instruction for enrolled social work students. The resolution was approved by the Personnel-Public Information-Human Resources-Housing Committee.

RESOLUTION NO. RS2014-1208

A resolution accepting a grant from the Greater Nashville Regional Council to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to provide personal care services, homemaker services, and Nutrition HCBS (Home and Community Based Services) to eligible clients under the options program. The resolution was approved by the Budget & Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-1211

A resolution approving the election of certain Notaries Public for Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1212

A resolution recognizing Court Appointed Special Advocates, on the occasion of their thirtieth anniversary. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1214

A resolution recognizing “The Star-Spangled Banner” on its 200th Anniversary. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

A resolution accepting a Friends of Two Rivers Mansion Grant from the Friends of Two Rivers Mansion to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide partial funding for one employee’s salary. A resolution approving a Sister City relationship with Kamakura, Japan and authorizing the Mayor to execute a Sister City Charter.

BILL NO. BL2014-871

An ordinance adopting property identification maps for The Metropolitan Government of Nashville and Davidson County, which shall be the official maps for the identification of real estate for tax assessment purposes. BILL NO. BL2014-872

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, hereinafter known as “METRO”, to participate with LPC Contractors of Southeast, Inc. hereinafter known as “LINCOLN”, to provide public water service improvements for both LINCOLN’s proposed development, as well as other existing properties in the area (Project No. 14-WL-0050). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

BILL NO. BL2014-873

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services herein after known as “METRO”, to participate with Laurel Property, LLC hereinafter known as “LAUREL”, to provide public water service improvements for both LAUREL’s proposed development, as well as other existing properties in the area (Project No. 14-WL-0052). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing 10 foot Public Utility Drainage Easement (“P.U.D.E.”) that was previously recorded in Plat Book 1835, Page 10 and in Plat Book 3106, Page 105 for properties located at 3622, 3622B, 3624, 3630, 3630B, and 3632 Redmon Street and at Normandy Circle (unnumbered), (Proposal No. 2014M-040ES-001). The bill was approved by the Planning Commission. The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-876

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights, not to include those retained by NES, in a portion of the former right-of-way of Alley #63 (closed via Council Ordinance BL2014-672) for a portion of the properties located at 700 Broadway and 126 Rosa L. Parks Boulevard (Proposal No. 2014M-039ES-001).
