ORDINANCE NO. BL2014-861

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to acquire permanent easements, temporary construction easements, or fee simple, through negotiations or condemnation for the Brick Church Pike Pipe Improvement Project and to upgrade and reconnect gravity pipes and realign the existing public sewer mains and associated easements for various properties located along Bellshire Terrace Drive, Brick Church Lane, Brick Church Pike, Briley Park Boulevard South, Briley Park Boulevard North, Dickerson Pike, Northbrook Drive, Mulberry Way, and Westchester Drive, (Project No. 11-SC-0144, OAP and Proposal No. 2014M-034ES-001).

WHEREAS, the negotiations or condemnation of permanent easements, temporary construction easements, or fee simple, the upgrade and reconnection of gravity pipes and the realignment of the existing public sewer mains and associated easements for various properties located along Bellshire Terrace Drive, Brick Church Lane, Brick Church Pike, Briley Park Boulevard South, Briley Park Boulevard North, Dickerson Pike, Northbrook Drive, Mulberry Way, and Westchester Drive, are needed to construct the Brick Church Pike Pipe Improvement Project No. 11-SC-0144, OAP; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-034ES-001 on June 5, 2014, for the negotiations or condemnation of permanent easements, temporary construction easements, or fee simple.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate, condemn, or fee simple take permanent easements, temporary construction easements, or fee simple for the Brick Church Pike Pipe Project, and to upgrade and reconnect gravity pipes and realign the existing public sewer mains and associated easements for various properties located along Bellshire Terrace Drive, Brick Church Lane, Brick Church Pike, Briley Park Boulevard South, Briley Park Boulevard North, Dickerson Pike, Northbrook Drive, Mulberry Way, and Westchester Drive as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations, condemnation, or fee simple take authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
