ORDINANCE NO. BL2014-893

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by closing and abandoning portions of the right-of-way and easements for Alleys Nos. 115 and 123, and to authorize the execution of a quitclaim deed to convey any interest the Metropolitan Government possesses in right-of-way that would not already be extinguished by the aforementioned abandonment (Proposal No. 2014M-012AB-001).

Whereas, the owner of the abutting properties has requested that the Metropolitan Government close and abandon the portion of the public right-of-way (the “ROW”) in Alleys Nos. 115 and 123, as shown on the sketch attached as Exhibit A; and,

Whereas, the closure and abandonment of the ROW has been requested by the Civic Site Design Group on behalf of Nashville Hospitality Capital, LLC (Grantee); and,

Whereas, the Metropolitan Government of Nashville and Davidson County has no further need for the ROW; and,

Whereas, in order to clarify the fee ownership of the property currently burdened by the ROW, Grantee has further requested that the Metropolitan Government quitclaim such interest as it may possess in such property to Grantee pursuant to the deed attached as Exhibit B.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. BL2013-600 be and hereby is amended, as follows:

Portions of the right-of-way and easements for Alleys Nos. 115 and 123, all of which are more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, are hereby abandoned.

Section 2. That said right-of-way, including all utility easements within it, are herein closed and abandoned.

Section 3. That the Director of the Department of Public Works be and hereby is authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

Section 4. That the Director of Public Property Administration or his designee is authorized to execute the quitclaim deed attached hereto as Exhibit B conveying such interest as the Metropolitan Government may have in the Property to Nashville Hospitality Capital, LLC.

Section 5. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
