ORDINANCE NO. BL2014-874

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing 10 foot Public Utility Drainage Easement (“P.U.D.E.”) that was previously recorded in Plat Book 1835, Page 10 and in Plat Book 3106, Page 105 for properties located at 3622, 3622B, 3624, 3630, 3630B, and 3632 Redmon Street and at Normandy Circle (unnumbered), (Proposal No. 2014M-040ES-001).

WHEREAS, the abandonment of an existing 10 foot P.U.D.E. that was previously recorded in Plat Book 1835, Page 10 and in Plat Book 3106, Page 105 for properties located at 3622, 3622B, 3624, 3630, 3630B, and 3632 Redmon Street and at Normandy Circle (unnumbered) has been requested by the property owner to allow for future development; and,

WHEREAS, there is no future need for said P.U.D.E. for Metropolitan Government of Nashville and Davidson County purposes; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-040ES-001 on June 20, 2014, for the abandonment of said P.U.D.E.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon an existing 10 foot P.U.D.E. that was previously recorded in Plat Book 1835, Page 10 and in Plat Book 3106, Page 105 for the properties located at 3622, 3622B, 3624, 3630, 3630B, and 3632 Redmon Street and at Normandy Circle (unnumbered), as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
