ORDINANCE NO. BL2014-870

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services (“METRO”), to enter into an agreement with Normandy II General Partners, hereinafter known as “NORMANDY II GP”, to fund a portion of the operation and maintenance of a public pressure sewer extension for its development at Fawn Crossing.

WHEREAS, NORMANDY II GP has expressed a desire to provide public pressure sewer extension through the previously constructed pump station and force main known as Project No. 06-SL-164 for its development Fawn Crossing; and,

WHEREAS, NORMANDY II GP agrees to fund a portion of the additional operation and maintenance costs for the previously constructed pump station and force main known as Project No. 06-SL-164 in the amount of $48,000.00 according to the terms of the Fawn Crossing Pumping Station Operation and Maintenance Agreement (Exhibit A).

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

Section 1. The Fawn Crossing Pumping Station Operation and Maintenance Agreement (Exhibit A) between the Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, with NORMANDY II GP, to provide public pressure sewer extension through the previously constructed pump station and force main known as Project No. 06-SL-164 for its development at Fawn Crossing, attached hereto and incorporated herein, is hereby approved, and the Director of Water and Sewer Services is authorized to execute the same.

Section 2. Amendments to this legislation shall be approved by resolution.

Section 3. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
