The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.
The invocation was offered by Pastor Chris Nichols of Crosspoint Community Church.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -
Auditorium Commission
Reappointment of Mr. John Landers for a term expiring June 30, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Stites moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Hospital Authority
Reappointment of Dr. Howard Burley for a term expiring July 11, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Mr. Stites moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
Property Standards & Appeals Board
Appointment of Ms. Peggy Coleman for a term expiring April 7, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Mr. Stites moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.
- RESOLUTION ON PUBLIC HEARING -
A resolution exempting Venue 109 located at 109 Cude Lane from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. Mr. Pardue requested a hearing from the public on this resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and citizens were heard in favor of and in opposition to passage of the resolution. The President declared the public hearing closed. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Pardue moved to defer the resolution to the second meeting in August, which motion was seconded and adopted by a voice vote of the Council.
- CONSENT AGENDA RESOLUTIONS -
A resolution appropriating a total of $2,150,000 from four accounts of the General Fund of the General Services District to various nonprofit organizations selected to receive community enhancement grant funds. The resolution was approved by the Budget and Finance Committee.
A resolution accepting a grant from the State of Tennessee, Department of Health, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to provide TENNderCare Outreach Services for Early, Periodic, Screening, Diagnosis, and Treatment (EPSDT) of enrolled children, including a new Welcome Baby Project. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.
A resolution authorizing the Metropolitan Government-owned property located at 3254 Ezell Pike to be used by the Department of Public Works as a convenience center pursuant to Section 2.206.010 of the Metropolitan Code. The resolution was approved by the Public Works and Planning, Zoning and Historical Committees.
A resolution approving Amendment Two which extends a deadline for information to be submitted by the Metropolitan Government in its agreement with the State of Tennessee, Department of Transportation, for Safety Improvement Program for crosswalks and pedestrian signals at four Harding Place intersections, PIN Number 114944.00. The resolution was approved by the Public Works Committee.
A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Dr. Stacey Williams against Metropolitan Nashville Police Department Officer Michael Pyle for $99,000.00, and that said amount be paid out of the Judgments and Losses Fund. The resolution was approved by the Budget and Finance Committee.
A resolution authorizing Nashville Trail, Inc. and Bootsnmore, Inc. and Betty Boots, LLC, Big Time Boots/Tri West to construct and install an aerial encroachment at 209 Broadway (Proposal No. 2014M-009EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.
A resolution authorizing Nashville Trail, Inc. and Bootsnmore, Inc. and Betty Boots, LLC, Big Time Boots, Tri West to construct and install an aerial encroachment at 301 Broadway (Proposal No. 2014M-005EN-001). The resolution was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.

An ordinance amending Chapter 7.08 of the Metropolitan Code to prohibit beer permits from being issued for establishments located within a shopping mall containing a community center and/or public library. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.
An ordinance amending Chapter 8.12 of the Metropolitan Code pertaining to the minimum size of outdoor animal enclosures. Upon motion duly seconded, the bill passed first reading and was referred to the Health, Hospitals and Social Services Committee by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon retained easement rights in a portion of the former right-of-way of 50th Avenue North (closed via Council Ordinance O74-1115) for property located at 4915 Illinois Avenue (Proposal No.2014M-030ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 200 linear feet of existing eight inch public sewer main and to accept approximately 1600 linear feet of eight inch public sewer main for property located at 440 Hogan Road (MWS Project No. 14-SG-0015 and Proposal No. 2014M-031ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 525 linear feet of existing eight inch public water main, 375 linear feet of eight inch public water main and the associated easement, and to accept approximately 1,263 linear feet of 10 inch D.I.P. water main, 355 linear feet of eight inch D.I.P. water main with seven fire hydrant assemblies, and 1,438 linear feet of eight inch sewer main and easements for various properties located south of Charlotte Avenue (MWS Project Nos. 13-WL-64 and 13-SL-61 and Proposal No. 2014M-033ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services (“METRO”), to enter into an agreement with Ole South/Craighead, hereinafter known as “OLE SOUTH”, to fund a portion of the additional operation and maintenance of a public pressure sewer extension for its development at Harvest Grove Phase 2 (Project No. 06-SL-83). Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Works Committees by a voice vote of the Council.

An ordinance amending Chapter 7.08 of the Metropolitan Code pertaining to the definition of “performing arts facility” for the purpose of obtaining a permit to sell beer. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance authorizing the Metropolitan Government to participate with the Cumberland River Compact to improve water quality in Davidson County by removing the low dam in Richland Creek at McCabe Golf Course. The bill was approved by the Budget and Finance and Parks, Library and Recreation Committees. Mr. Holleman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance providing the honorary designation of “Keaton’s Cut Place” for a portion of Old Clarksville Pike. The bill was approved by the Budget and Finance Committee; the Public Works Committee recommended deferment. Mr. Garrett moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.
An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before February 5, 2014. The bill was approved by the Rules-Confirmations-Public Elections Committee. Mr. Stites moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County by abandoning a portion of right-of-way for Alley No. 1999 (Proposal No. 2014M-008AB-001).

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 175 linear feet of a 20 foot public water main easement recorded in Book 1130, Page 55, in which Metro Water Services removed the former 18 foot public water main installed in the easement in 1998 for the property located at 3516 Wrenwood Drive, (Proposal No. 2014M-026ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Holleman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 77 linear feet of eight inch public sewer main and easement and to accept one new public sewer manhole for properties located at 301, 307, and 315 8th Avenue South and 300 and 312 9th Avenue South, (MWS Project No. 14-SL-0050 and Proposal No. 2014M-027ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees.
