RESOLUTION NO. RS2014-1161

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Dr. Stacey Williams against Metropolitan Nashville Police Department Officer Michael Pyle for $99,000.00, and that said amount be paid out of the Judgments and Losses Fund.

WHEREAS, on May 15, 2012, Metropolitan Police Officer Michael Pyle responded to a call by the Metropolitan Nashville Fire Department to remove an unruly bystander from the scene of a baby locked in a vehicle; and

WHEREAS, the bystander, Dr. Stacey Williams, the infant’s pediatrician, was injured when Officer Pyle attempted to remove her from the scene; and

WHEREAS, the criminal charges against Dr. Williams for disorderly conduct and resisting arrest were dismissed and Dr. Williams then brought this lawsuit in United States District Court, Docket No. 3:12-cv-1273, against Officer Pyle; and

WHEREAS, after investigation, the Metropolitan Department of Law believes that the settlement listed in Section 1 is fair and reasonable and in the best interests of the Metropolitan Government and Officer Michael Pyle, and recommends that the claims of Dr. Stacey Williams be compromised and settled for $99,000.00, which includes attorneys’ fees, and that this amount be paid from the Judgments and Losses Fund.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1: The Metropolitan Department of Law is authorized to compromise and settle the claims of Dr. Stacey Williams for the sum of $99,000.00, with said amount to be paid from the Judgments and Losses Fund.

Section 2: This resolution shall take effect from and after its adoption, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
