ORDINANCE NO. BL2014-840

An Ordinance amending Chapter 7.08 of the Metropolitan Code to prohibit beer permits from being issued for establishments located within a shopping mall containing a community center and/or public library.

BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Title 7 of the Metropolitan Code, the Alcoholic Beverage Laws of The Metropolitan Government of Nashville and Davidson County, is hereby amended by amending Section 7.08.090 by adding following new subsection G:

G. No beer permit shall be issued to an applicant whose location is within or attached to an indoor shopping mall that has a community center operated by the metropolitan department of parks and recreation and/or a public library on the premises. For purposes of this subsection, “indoor shopping mall” means a shopping center with stores and businesses facing a system of enclosed walkways for pedestrians.

Section 2. This Ordinance shall take effect from and after its enactment, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.

Madam President:

I move to amend Ordinance No. BL2014-840 by deleting the phrase “beer permit” wherein it appears in Section 1 and substituting with the phrase "retailer off-sale permit".
