The Metropolitan Council met in regular session on this date at 6:00 p.m. in the Metropolitan Courthouse.
The invocation was offered by Councilmember Lynn Williams.
The Metropolitan Council gave the pledge of allegiance to the American Flag.

- BILLS ON PUBLIC HEARING -
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to MUL district properties located at 103 and 105 West Trinity Lane, approximately 120 feet west of Dickerson Pike (.48 acres), all of which is described herein (Proposal No. 2006Z-046U-05). The bill was approved by the Planning Commission. Ms. Murray requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Murray moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM15 zoning property located at 8921 Collins Road, approximately 275 feet west of Collinswood Drive (2.5 acres), all of which is described herein (Proposal No. 2006Z-130G-06). The bill was disapproved by the Planning Commission. Mr. Tygard moved to defer the bill to the March public hearing, the bill being requested by A.W. Chaffin, Edna L. Chaffin, R.S. Chaffin, Melissa L. Chaffin, Don Einwag and Sherrill D. Einwag, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Section 17.20.120 of Title 17 of the Metropolitan Code, Zoning Regulations, by modifying the basis for calculating a financial contribution in lieu of sidewalk construction, all of which is more specifically described herein (Proposal No. 2006Z-164T). The bill was disapproved by the Planning Commission. In the absence of the sponsor, the bill was deferred to the March public hearing by a voice vote of the Council.
An ordinance amending Chapters 17.04, 17.08, 17.16 and 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, by designating "Car Wash" as a use permitted with conditions (PC), and adding certain conditions pertaining to car washes, all of which is more specifically described herein (Proposal No. 2006Z-165T). The bill was approved by the Planning Commission. Ms. Neighbors requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Ms. Neighbors moved to pass the bill on second reading, which motion was seconded and adopted by a roll call vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to CS district property located at Una Antioch Pike (unnumbered), along the northeast corner of Una Antioch Pike and Goodwin Drive (0.23 acres), all of which is described herein (Proposal No. 2006Z-030U-13). Mr. Alexander moved to defer the bill to the March public hearing, the bill being requested by James A. Rust and Mitchell Whitson et ux, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Section 17.16.160 of Title 17 of the Metropolitan Code, Zoning Regulations, by replacing the special exception standards for Historic Homes Events with new standards, all of which is more specifically described herein (Proposal No. 2006Z-170T). The bill was approved by the Planning Commission. Mr. Summers requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. Petitions were filed in favor of the bill. The President declared the public hearing closed. Mr. Summers moved to pass the bill on second reading and defer the bill to the second meeting in March, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to SP zoning property located at 711 and 713 40th Avenue North, at the southwest corner of Clifton Avenue and 40th Avenue North (.54 acres), to permit the development of 10 townhomes, all of which is described herein (Proposal No. 2006SP-135U-08). Mr. Whitmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Whitmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning property located at 13880 Old Hickory Boulevard and Old Hickory Boulevard (unnumbered), approximately 465 feet west of Legacy Drive (173.9 acres), to permit the development of 200 townhouses and 700 single-family houses, all of which is described herein (Proposal No. 2006SP-181G-12). The bill was approved by the Planning Commission. Mr. Coleman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Coleman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council with Mr. Greer voting "No."
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CF to SP zoning properties located at 141, 147, 149, 151, 161, and 165 2nd Avenue South and 140 and 150 3rd Avenue South, and 3rd Avenue South (unnumbered) at the northeast corner of 3rd Avenue South and Demonbreun Street (1.59 acres), to permit the development of a mixed-use, 28 story office/retail building, all of which is described herein (Proposal No. 2006SP-161U-09). The bill was approved by the Planning Commission. Mr. Jameson requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of passage of the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CF to SP zoning property located at 203, 205, 207, 209, 215, 217, and 221 Broadway; 109, 110, 113, 116, and 119 2nd Avenue South, bounded by Broadway, 2nd Avenue South, and 3rd Avenue South (1.16 acres), to permit a 375-room hotel with retail and restaurant uses, and 48 condominiums, all of which is described herein (Proposal No. 2006SP-183U-09). The bill was approved by the Planning Commission. Mr. Jameson requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to RS5 zoning property located at 1006 44th Avenue North, approximately 210 feet north of Albion Street (0.16 acres), all of which is described herein (Proposal No. 2006Z-168U-08). The bill was approved by the Planning Commission. Mr. Whitmore requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Whitmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to SP zoning properties located at 2721 and 2725 Nolensville Pike, and 2722 Grandview Avenue, at the northwest corner of Nolensville Pike and McClain Avenue (0.82 acres), to permit the expansion of an existing used car sales lot, all of which is described here in (Proposal No. 2006SP-152U-11). The bill was approved by the Planning Commission. Ms. Page requested a hearing from the public on this bill which had been previously advertised. An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by amending Section 17.40.120 to require that all planned unit developments inactive for more than six years be submitted to the Metro Council for approval prior to the issuance of any building or grading permit (Proposal No. 2006Z-186T). The bill was disapproved by the Planning Commission. Mr. Tygard moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Chapter 17.08 of Title 17 of the Metropolitan Code, Zoning Regulations, by deleting rehabilitation services as a permitted use in the AG and AR2a districts, all of which is more specifically described herein (Proposal No. 2006Z-191T). The bill was disapproved by the Planning Commission. Mr. Ryman requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and a citizen was heard in opposition to passage of the bill. The President declared the public hearing closed. Mr. Ryman moved to pass the bill on second reading and defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Chapters 17.04, 17.08, 17.12, 17.16 and 17.20 of Title 17 of the Metropolitan Code, Zoning Regulations, to modify the definition of "mobile vendor", to designate mobile vendor as a use permitted with conditions, and to add certain conditions applicable to mobile vendors, all of which is more specifically described herein (Proposal No. 2006Z-190T). The bill was approved by the Planning Commission. Mr. Craddock requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Craddock moved to pass the bill on second reading, which motion was seconded. Mr. Greer moved to defer the bill indefinitely, which motion was seconded. Mr. Gotto move to table the motion to defer, which motion was seconded and adopted by a voice vote of the Council. The matter recurred on the motion to pass on second reading, which motion was adopted by a voice vote of the Council.
An ordinance amending Section 17.40.106 of Title 17 of the Metropolitan Code of Laws, Zoning Regulations, to require development plans for Specific Plan zoning districts to be filed with the Metropolitan Clerk prior to consideration by the Council of the Specific Plan rezoning ordinance (Proposal No. 2006Z-195T). The bill was disapproved by the Planning Commission. Mr. Wallace requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Wallace moved to pass the bill on second reading and defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by creating a passive park as a new recreational land use, by providing that passive parks be permitted by right in non-residential districts and be permitted by special exception in residential districts, all of which is more particularly described herein (Proposal No. 2006Z-196T). Ms. Williams moved to defer the bill to the March public hearing, which motion was seconded and adopted by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning, property located at 6419 Pettus Road, at the end of Autumn Crossing Way, to permit 69 single-family lots and 64 multi-family units (28.99 acres), all of which is described herein (Proposal No. 2006SP-112G-12). The bill was approved by the Planning Commission. Mr. Toler requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Toler moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
An ordinance amending Title 17 of the Metropolitan Code, Zoning Regulations, by repealing Ordinance No. BL2006-972, which made certain automobile repair, services, and sales uses permitted only within the Specific Plan (SP) district, and modified the definition of these uses and land use tables accordingly (Proposal No. 2007Z-001T). By rule requiring Planning Commission action, the bill was deferred to the March public hearing.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CC to SP zoning property located at 501 Church Street, at the southwest corner of Church Street and 5th Avenue North (1.23 acres), to permit the development of a 1,396,000 square foot building, including 435 residential condos, 197 hotel rooms, 17,000 square feet of restaurant and retail space, all of which is described herein (Proposal No. 2006SP-178U-09). The bill was approved by the Planning Commission. Mr. Jameson requested a hearing from the public on this bill which had been previously advertised. The bill was approved by the Planning Commission. Mr. Forkum requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by canceling a portion of a Planned Unit Development district located at 247 Old Hickory Boulevard, along the west side of Old Hickory Boulevard, 450 feet north of Belle Forest Circle, approved for a 2,603 square foot convenience market and a 615 square foot car wash, all of which is described herein (Proposal No. 28-81-G-06). The bill was approved by the Planning Commission. Mr. Crafton requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RM9 properties located at 7140 Carothers Road and Carothers Road (unnumbered), (87.07 acres total) all of which is described herein (Proposal No. 2006Z-185G-12). The bill was approved by the Planning Commission.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Urban Design Overlay district at Kidd Road (unnumbered) Battle Road (unnumbered), 7140, 7176, 7107, 7211, and 7244 Carothers Road, and Carothers Road (unnumbered) (599 acres total), to permit the addition of 87.07 acres into the existing UDO and to increase the number of residential units from 2,300 to a maximum of 3,000 units and to increase from 150,000 square feet to 200,000 square feet of commercial space, all of which is more particularly described herein (Proposal No. 2005UD-003G-12). - BILLS ON INTRODUCTION AND FIRST READING -
An ordinance authorizing the Director of Public Property to exercise an option to purchase real property (Map 85, Parcels 17 and 18 - 1015 and 1014 Stones River Road) to be used by Parks and Recreation as part of the Stones River greenway system and as a Nature Center, and to grant a conservation easement to The Land Trust for Tennessee, Inc. (Proposal No. 2006M-224G-14). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Parks, Library, Recreation and Public Entertainment Facility and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance amending Section 6.80.550 of the Metropolitan Code to eliminate the $200.00 storage fee for items stored at the Police Department Impound Lot, except for those items that are seized by the Police Department as a result of suspected criminal activity. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees by a voice vote of the Council.
An ordinance amending Chapter 12.52 of the Metropolitan Code to make persons operating motorized wheelchairs or similar vehicles or devices subject to the same regulations and privileges provided to pedestrians. Upon motion duly seconded, the bill passed first reading and was referred to the Public Safety-Beer and Regulated Beverages Committee by a voice vote of the Council.
An ordinance amending Chapter 13.08 of the Metropolitan Code pertaining to the naming of public rights-of-way in honor of persons who are deceased. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.
An ordinance authorizing a property tax exemption for nonprofit community and performing arts organizations in accordance with Tennessee Code Annotated § 67-5-223. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.
An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R20 to RS20 zoning various properties located east of Highway 100 on Page Road, Heady Drive, West Tyne Drive, Gilman Avenue, Taggart Avenue, Brookfield Avenue, Alton Road, Cheek Road, and Clydelan Court (172.56 acres), all of which is described herein (Proposal No. 2007Z-008U-07). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission and Planning, Zoning and Historical Committee by a voice vote of the Council.
