Metropolitan Council Meeting
Tuesday, October 16, 2001


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend James Thomas of Jefferson Street Baptist Church.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Charitable Solicitations Board

Reappointment of Ms. Shelby Tabeling to the Charitable Solicitations Board for a term expiring October 9, 2004. In the absence of the appointee, the confirmation was deferred without objection.

Reappointment of Mr. James Taylor Jr. to the Charitable Solicitations Board for a term expiring October 9, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Community Access Television Corporation Board

Reappointment of Mr. Samuel Coleman to the Community Access Television Corporation Board for a term expiring October 10, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Pat Nolan to the Community Access Television Corporation Board for a term expiring October 10, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Dr. Henry Onyejiaka to the Community Access Television Corporation Board for a term expiring October 10, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Convention Center Commission

Reappointment of Ms. Denise McBride to the Convention Center Commission for a term expiring June 7, 2004. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission

Reappointment of Ms. Margaret Slater to the Historical Commission for a term expiring August 10, 2005. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission

Appointment of Ms. Judy Cummings to the Planning Commission for a term expiring March 31, 2003. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Wastewater Hearing Authority

Reappointment of Mr. Albert Malone to the Wastewater Hearing Authority for a term expiring October 1, 2002. The Rules-Confirmations-Public Elections Committee recommended the appointment, and Ms. Williams moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2000-125

A resolution requesting the Metropolitan Traffic and Parking Commission to provide 30 minutes of free parking in all Metro-owned lots and garages. The Traffic and Parking Committee recommended deferment of the resolution. Mr. Wallace moved to defer action on the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2001-782

A resolution in support of Project Help and other energy assistance programs. The resolution was approved by the Budget and Finance Committee. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees with an amendment. An ordinance to abandon four triangular-shaped pieces of public right-of-way each measuring 48 square feet and two 5 foot public utility easements on parcels 293 and 485 on tax map 82-9, located between Monroe Street, Madison Street, Fifth Avenue North, and Alley No. 202 (Proposal No. 2001M-106U-08), all of which is more particularly described herein. An ordinance amending Section 12.40.040 of the Metropolitan Code by permitting parking within the Central Business Improvement District during certain evenings in some spaces where parking is now prohibited. The bill was disapproved by the Traffic and Parking Commission and the Traffic and Parking Committee recommended deferment. Mr. Wallace moved to defer action on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-819

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by renaming portions of McCrory Creek Road and Couchville Pike; and by naming an unnamed road, (Proposal No. 2000M-108U-13), all of which is more particularly described herein. The bill was approved by the ECD Board, Public Works, Traffic and Parking and Planning, Zoning and Historical Committees; the Planning Commission recommended disapproval. An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by changing the name of 22nd Avenue South to "Golf Club Place", (Proposal No. 2001M-041U-10), all of which is more particularly described herein. An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for the Metropolitan Government of Nashville and Davidson County, by abandoning an unbuilt portion of Long Meadow Drive, (Proposal No. 2001M-050U-07), all of which is more particularly described herein. The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works, and Traffic and Parking Committees; the Planning, Zoning and Historical Committee recommended deferment. Mr. Summers moved to suspend the rules to override the committee recommendation for deferment, which motion was seconded and adopted without objection. BILL NO. BL2001-841

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Book Publishing Company, including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before May 15, 2001. The bill was approved by the Rules-Confirmations-Public Elections Committee. Mr. Majors moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-842

An ordinance amending the Metropolitan Code by repealing Chapter 8.08 VICIOUS DOGS, and adopting a new Chapter 8.08 relating to vicious dogs. The Health, Hospitals and Social Services Committee recommended deferment of the bill. Ms. Sontany moved to defer action on the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2001-843

An ordinance amending the Metropolitan Code by amending Chapter 8.12 relating to cruelty to animals and providing authority for chemical capture of animals. The Health, Hospitals and Social Services Committee recommended deferment of the bill. Ms. Sontany moved to defer action on the bill, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing the acceptance of the donation of certain property (Tax Map 61-11, Parcels 299 and 305) on Matthews Avenue for the use and benefit of the Metropolitan Department of Public Works (Proposal No. 2001M-093U-05). The bill was approved by the Planning Commission, Budget and Finance, Public Works and Planning, Zoning and Historical Committees.
