A resolution approving a second amendment to a grant between the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs, to The Metropolitan Government of Nashville and Davidson County, acting through the General Sessions Court for a Mental Health Court.

Whereas, the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs has awarded a grant in an amount not to exceed one hundred sixty thousand three hundred seventy two dollars ($160,372) to the Metropolitan Government of Nashville and Davidson County, acting through the General Sessions Court for the establishment of a Mental Health Court to address the problems of defendants who are mentally ill or developmentally disabled and such grant was approved and accepted by The Metropolitan Council by ordinance (Bill No. BL2000-416); and,

Whereas, the parties amended the contract by increasing the grant award and such amendment was approved by the Metropolitan Council by Resolution No. 2001-710; and

Whereas, said amendment omitted the grant award amount for fiscal year 2002-2003; and

Whereas, the parties, by mutual agreement, wish to further amend the contract by correcting the omission by deleting paragraph C.1 in its entirety and replacing it with a new paragraph that reflects the award amount of seventy nine thousand five hundred eighty-four dollars ($79,584) for fiscal year 2002-2003; and

Whereas, Bill No. 2000-416 provided that amendments to the Grant may be approved by Resolution by the Metropolitan Council receiving twenty-one affirmative votes;

Whereas, it is deemed to be in the best interest of The Metropolitan Government that this amendment to the contract be approved.

Now, therefore, be it resolved by The Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the amendment to the Grant by and between the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs and The Metropolitan Government of Nashville and Davidson County, acting through the General Sessions Courts, which amendment corrects the award amount of seventy nine thousand five hundred eighty-four dollars ($79,584) for fiscal year 2002-2003; a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That this Resolution shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
