ORDINANCE NO. BL2001-837

An ordinance authorizing Southern Woods Section Six, LP, hereinafter known as "SOUTHERN WOODS" to participate with the Metropolitan Government, Department of Water and Sewerage Services, hereinafter known as "METRO" for the construction of Project No. 97-SG-84, Owl Creek Trunk Sewer.

WHEREAS, METRO provides sewerage service in Williamson County; and

WHEREAS, SOUTHERN WOODS has expressed a desire to provide improved public sewer service in Williamson County, TN, hereinafter known as Southern Woods Section Six; and

WHEREAS, METRO has funded and built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000 per connection as basin fees; and

WHEREAS, it is deemed to benefit both parties and the general community, and SOUTHERN WOODS agrees to pay an amount not to exceed $4,000; and

WHEREAS, this work is identified in METRO's Capital Improvements Budget as Project No. 96SG0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That METRO is hereby authorized to accept from SOUTHERN WOODS $4,000 for two connections @ $2,000 each toward the funding of the Owl Creek Trunk Sewer Project No. 97-SG-84.

SECTION 2: That future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
