Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Pastor Jeff Nichols of The Donelson Fellowship.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Metropolitan Action Commission
Reappointment of Ms. Kasey Anderson for a term expiring April 30, 2019. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Equalization
Reappointment of Mr. Robert Notestine for a term expiring April 1, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Marshall Winkler for a term expiring April 1, 2018. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market Board
Reappointment of Ms. Priscilla Norman for a term expiring May 5, 2021. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Appointment of Mr. David Garrison for a term expiring April 18, 2019. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Freddie Carr for a term expiring April 30, 2018. At the requested of the appointee, the nomination was deferred.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2016-224

A resolution to establish a new fee structure for private collection permit fees for waste haulers pursuant to Metropolitan Code Section 10.20.100. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2016-225

A resolution to establish a new fee structure associated with the processing and review of Metro Planning Commission applications associated with Title 17 of the Metropolitan Code (Proposal No. 2016Z-008TX-001). The resolution was approved by the Planning Commission, Budget and Finance, and Planning, Zoning, and Historical Committees.

RESOLUTION NO. RS2016-272

A resolution approving a contract with Arthur J. Gallagher & Co. for purchase of insurance services for the Metropolitan Government. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-274

A resolution approving a clinical affiliation agreement between the State of Tennessee, by and through Columbia State Community College, and the Metropolitan Government of Nashville and Davidson County, by and through the Nashville Fire Department, for the participation and clinical training of students enrolled in the Emergency Medical Technician Programs of the institution. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee.

RESOLUTION NO. RS2016-275

A resolution authorizing Headquarters Tennessee LLC to construct and install an aerial encroachment at 114 2nd Avenue South for (Proposal No.2016M-014EN-001). The resolution was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees.

RESOLUTION NO. RS2016-276

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Sherman Carver and Tiffany Carver against the Metropolitan Government of Nashville and Davidson County in the amount of $27,372.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2016-278

A resolution supporting the application to the U.S. Department of Housing and Urban Development for a Choice Neighborhoods Implementation Grant for the Cayce Neighborhood and authorizing the Metropolitan Government to serve as the Co-Applicant with the Metropolitan Development and Housing Agency. The resolution was approved by the Budget and Finance Committee.

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Four Hundred Seventy-Five Million Dollars. The resolution was approved by the Budget and Finance Committee with two amendments. Mr. Cooper offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2016-273

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, to enter into Utility Relocation Contract No. 8532 with the State of Tennessee, Department of Transportation, to construct PIN Number 121040.00, SR-1 (Murfreesboro Road) from Vultee Boulevard to Jupiter Drive and Intersection of SR-1 at Kermit Drive, located in Davidson County, Tennessee, (State Project No. 19021-3251-14 and Project No. 15-WG-0162). The resolution was approved by the Budget and Finance and Public Works Committees with an amendment. Mr. Pridemore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. RESOLUTION NO. RS2016-277

A resolution requesting that the Tennessee General Assembly and Gov. Bill Haslam communicate with Nashville’s business groups and community before passing legislation that could be detrimental to Nashville & Davidson County commerce. The resolution was approved by the Convention, Tourism and Public Entertainment Facilities Committee. The Budget and Finance Committee deferred by rule. Pursuant to Rule No. 24, the resolution was deferred.

Without objection, the rules were suspended for consideration of one (1) late resolution.

RESOLUTION NO. RS2016-279

A resolution accepting a grant from the State of Tennessee, Office of Criminal Justice Programs, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Family Safety, for a Family Justice Center Advocate/Navigator position to assist clients as they enter the Family Justice Center and to help with data collection. The resolution was approved by the Public Safety, Beer, and Regulated Beverages Committee. An ordinance approving an agreement between the Nashville Fire Department and Vanderbilt University Medical Center for the clinical training of Vanderbilt residents. BILL NO. BL2016-302

An ordinance granting a franchise to TN Backhaul Networks, LLC, to construct, operate, and maintain a telecommunications system within Metropolitan Nashville and Davidson County under the provisions of Metropolitan Code of Laws, Title 6, Chapter 26 (Proposal No. 2016M-001FR-001). Upon motion duly seconded, the bill passed first reading and was referred to the Planning Commission, Budget and Finance, Planning, Zoning, and Historical, and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-303

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept new sewer mains for property located at 12th Avenue North and Broadway (MWS Project No. 15-SL-224 and Proposal No. 2016M-024ES-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical and Public Works Committees by a voice vote of the Council.

BILL NO. BL2016-304

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for property located at 1016 33rd Avenue North, approximately 70 feet south of Alameda Street (0.29 acres), to permit four residential units within the existing structure, all of which is described herein (Proposal No. 2016SP-036-001). The bill was approved by the Planning Commission with conditions, disapproved without. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-305

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUL-A zoning for property located at 615 26th Avenue North, at the southeast corner of Clifton Avenue and 26th Avenue North (0.75 acres), all of which is described herein (Proposal No. 2016Z-032PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-306

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to MUL-A zoning for property located at 2701, 2703, and 2705 Clifton Avenue, at the southwest corner of the intersection of Clifton Avenue and 27th Avenue North (0.67 acres), all of which is described herein (Proposal No. 2016Z-046PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning, and Historical Committee by a voice vote of the Council.

BILL NO. BL2016-223

An ordinance to amend Titles 12 and 16 of the Metropolitan Code of Laws of Nashville and Davidson County to establish a speed limit at major construction and demolition sites and to provide appropriate signage. The bill was approved by the Public Safety, Beer, and Regulated Beverages, Public Works, and Traffic, Parking and Transportation Committees with an amendment. Mr. Pridemore offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Pridemore moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-255

An ordinance to amend Chapter 2.32 of the Metropolitan Code to require the Office of Fleet Management, under the Department of General Services, to adopt the necessary rules and policies that prioritize the servicing and repair of police vehicles, fire engines, and other emergency response vehicles. At the request of the sponsor, the Public Safety, Beer, and Regulated Beverages Committee recommended deferment. Mr. Hagar moved to defer the bill to the second meeting in July, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-256

An ordinance amending Title 16 of The Metropolitan Code, Buildings and Construction, Property Standards, by amending Section 16.04.172 and Section 16.24.190 to clarify the basis for the denial of permits to applicants guilty of and in current violation of Title 16, all of which is more particularly described herein. At the request of the sponsor, the Codes, Fair, and Farmers Market Committee recommended indefinite deferment. Mr. Freeman moved to defer the bill indefinitely, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-257

An ordinance amending Section 16.04.1110 and Section 6.28.030 of the Metropolitan Code of Laws regarding noncompliance with Title 16 and the penalties therefor. At the request of the sponsor, the Codes, Fair, and Farmers Market Committee recommended deferment. Mr. Sledge moved to defer the bill, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-258

An ordinance authorizing the conveyance of the Metropolitan Government’s interest in the building and parcel of property located at 225 Polk Avenue (Proposal Number 2016M-017PR-001). The bill was approved by the Planning Commission, Budget and Finance and Planning, Zoning, and Historical Committees. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-259

An ordinance to require that the Metropolitan Transit Authority, in conjunction with any other related entities, provide to the Metropolitan Council, no later than December 31, 2016, a comprehensive mass transit plan for Nashville and Davidson County. The bill was approved by the Budget and Finance and Traffic, Parking, and Transportation Committees. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-260

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before April 20, 2016. The bill was approved by the Rules, Confirmations, and Public Elections Committee. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-261

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an existing sewer main and easement and to accept one new sewer manhole assembly and easement for property located at 420 Donelson Pike (MWS Project No. 16-SL-0043 and Proposal No. 2016M-023ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees. Mr. Syracuse moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-262

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon existing sewer main and easement and to accept new sewer main and easement for properties located at 800 and 802 Marquette Drive (MWS Project No. 16-SG-0059 and Proposal No. 2016M-021ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees. Ms. Mina Johnson moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-263

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights that were previously retained by Council Bill No. 2015-1020 within the right of way of Alley No. 160 for properties located at 710 and 706 Division Street (Proposal No. 2016M-022ES-001). The bill was approved by the Planning Commission, Planning, Zoning, and Historical, and Public Works Committees. Mr. O’Connell moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-264

An ordinance authorizing the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, hereinafter known as “Metro,” to participate with Eugene H. Nelson hereinafter known as “Nelson,” to provide public water service improvements for Nelson’s proposed development, as well as other existing properties in the area (Project No. 15-WL-0153). The bill was approved by the Budget and Finance and Public Works Committees. Mr. Sledge moved to pass the bill on second reading, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2016-190

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from SP to R6 zoning for property located at 715 Stockell Street, at the southeast corner of Stockell Street and Hancock Street (0.20 acres), all of which is described herein (Proposal No. 2015Z-089PR-001). The bill was disapproved by the Planning Commission. The Planning, Zoning, and Historical Committee deferred by rule. Pursuant to Rule No. 24, the resolution was deferred.

An ordinance to amend the Geographic Information Systems Street and Alley Centerline Layer for the Metropolitan Government of Nashville and Davidson County, by changing the name of an unimproved portion of Rosecliff Drive to “Colbert Drive” from Rosebank Avenue westward to its terminus (Proposal Number 2016M-001SR-001). An ordinance amending Sections 13.20.030, 2.62.030, 2.62.040, 2.62.050, and Chapter 12.56 of the Metropolitan Code to increase fees for various services provided by the Metropolitan Department of Public Works to more accurately reflect that department’s cost of providing these services.
