RESOLUTION NO. RS2016-224

A proposed resolution to establish a new fee structure for private collection permit fees for waste haulers pursuant to Metropolitan Code Section 10.20.100.

WHEREAS, pursuant to 10.20.100 of the Metropolitan Code: “Any person who for a fee collects garbage, rubbish, construction and demolition waste, or industrial waste within a mobile waste container within the limits of the metropolitan government or hauls or transports garbage, rubbish, construction and demolition waste or industrial waste by means of a vehicle on any public highway, road, street or alley within the limits of the metropolitan government shall obtain each year a private collection permit from the department for each such vehicle or mobile waste container;” and,

WHEREAS, pursuant to the authority of Section 10.20.100 of the Metropolitan Code of Laws, the Department of Public Works has developed for the Metropolitan Council’s consideration a new fee structure for private collection permits for waste haulers; and,

WHEREAS, pursuant to Section 10.20.100 of the Metropolitan Code of Laws, the adoption of a new fee structure may be accomplished by resolution; and,

WHEREAS, a new fee structure, reflected below, has been proposed by the Department of Public Works and reviewed by the Metropolitan Finance Department for its revenue affects; and,

WHEREAS, the new fee schedule reflected below will allow the Department of Public Works to recover more of its costs in connection with providing waste collection and disposal services; and,

WHEREAS, the Metropolitan Council finds, based on the Department of Public Works’ recommendation, it fitting and proper to revise the private collection permit fee schedule.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. That the private collection permit fee schedule below is hereby approved and adopted by the Metropolitan Council as is provided for in Section 10.20.100 of the Metropolitan Code:

$60.00/year/small truck (vehicles less than 3 cubic yards capacity)

$120.00/year/large truck (vehicles in excess of 3 cubic yards capacity)

$12.00/year/mobile waste container (commonly known as a dumpsters, compactors or rolloff containers)

Section 2. That this resolution shall be effective immediately upon its adoption, the public welfare requiring it.
