The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Council member Erica Gilmore.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

- ELECTIONS AND CONFIRMATIONS -

Convention Center Authority
Reappointment of Mr. Randy Goodman for a term expiring September 30, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Ms. Vonda McDaniel for a term expiring September 30, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. William McDonald for a term expiring September 30, 2019. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Housing Trust Fund Commission
Reappointment of Ms. Martha Silva for a term expiring September 17, 2020. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Metropolitan Transit Authority
Appointment of Mr. Walter Searcy III for a term expiring May 18, 2018. Mr. Searcy will fill the unexpired term of Mr. Freddie O’Connell. The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transportation Licensing Commission
Reappointment of Mr. Curt Wallen for a term expiring October 10, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Electric Power Board
Appointment of Ms. Carolyn Schott for a term expiring July 1, 2016. Ms. Schott will fill the unexpired term of Mr. Bob Mendes.
The Rules-Confirmations-Public Elections Committee recommended the appointment. Mr. Shulman moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council with Mr. Elrod abstaining.

Industrial Development Board
The President called for an election to fill four vacancies on The Industrial Development Board of The Metropolitan Government of Nashville and Davidson County for three (3) terms expiring August 23, 2021 and one (1) term expiring August 23, 2017. Nominations previously made were: Ms. Cristina Allen; Mr. Eddie Gray III; Mr. Chris Harmon; Mr. K. Clay Haynes; Mr. Nigel Hodge; Ms. Saletta Holloway; Ms. Lara Tucker; Mr. Kenneth W. Weaver; Mr. Howard Wedekind; Mr. Jeff Weems; Mr. Jeff Wilson; Ms. Erin Coleman and Mr. Brad Pickett having withdrawn their respective nominations. The Rules-Confirmations-Public Elections Committee reported that the candidates had been interviewed and all were found qualified to serve.

RESOLUTION NO. RS2015-34

A resolution exempting Turnip Truck Natural Market located at 701 Woodland Street from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Withers requested a hearing from the public on this resolution which had been previously advertised. The President Pro Tempore asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President Pro Tempore declared the public hearing closed. - BILLS ON PUBLIC HEARING -

BILL NO. BL2015-13

An ordinance amending Chapters 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, designating “mineral extraction” as a use permitted with conditions in the IG zoning district and adding conditions applicable to this use, all of which is more particularly described herein (Proposal No. 2015Z-016TX-001). The bill was approved by the Planning Commission with amendments. Mr. Hagar requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Hagar offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Hagar moved to pass the bill on second reading as amended, which motion was seconded. After discussion, Mr. Glover called for the previous question, which motion was seconded and approved by a voice vote of the Council. The matter recurred on the motion to pass and was approved by a voice vote of the Council.

BILL NO. BL2015-14

An ordinance amending Chapters 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, establishing “asphalt plant” and “concrete plant” as uses permitted with conditions in the IG zoning district and adding conditions applicable to these uses, all of which is more particularly described herein (Proposal No. 2015Z-017TX-001). The bill was approved by the Planning Commission with amendments. Mr. Hagar requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill. The President declared the public hearing closed. Mr. Hagar offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Hagar moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS5 to RM20-A zoning for property located at 104 Lucile Street, approximately 190 feet east of Dickerson Pike (0.28 acres), all of which is described herein (Proposal No. 2015Z-072PR-001). The bill was approved by the Planning Commission. Mr. Scott Davis requested a hearing from the public on this bill which had been previously advertised. The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Glover requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2015-20

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OL and RS10 to SP zoning for properties located at 100 and 102 Thompson Lane, approximately 485 feet west of Hartford Drive (3.02 acres), to allow uses permitted under the OR20-A zoning district, all of which is described herein (Proposal No. 2015SP-089-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Freeman moved to defer the bill to the March public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-21

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Central Pike South Specific Plan District for properties located at 4124, 4140, 4144 and 4156 Central Pike and 6002 South New Hope Road, approximately 1,450 feet east of Old Hickory Boulevard (25.93 acres), to allow additional commercial uses, revise bulk standards, and to modify the conditions of approval from Council Bill BL2011-885, all of which is described herein (Proposal No. 2011SP-005-002). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Glover requested a hearing from the public on this bill which had been previously advertised. SUBSTITUTE BILL NO. BL2015-25

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Hillsboro Village UDO to add text to the Building Façade standard, for all subdistricts, to reflect appropriate window and door opening orientation and alignment, and to add a definition of a mezzanine and a requirement that mezzanines are to be counted as an individual story (26.91 acres), all of which is described herein (Proposal No. 2005UD-009-004). Ms. Allen moved to defer the bill to the January public hearing, which motion was seconded and approved by a voice vote of the Council.

BILL NO. BL2015-26

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OL to MUL zoning for properties located at 208 and 212 McGavock Pike, approximately 420 feet south of Lebanon Pike (1.7 acres), all of which is described herein (Proposal No. 2015Z-077PR-001). The bill was approved by the Planning Commission. Mr. Syracuse requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by amending the Commercial Planned Unit Development district located at 13000 and 13010 Old Hickory Boulevard, approximately 480 feet south of Owen Drive, zoned IR (5.75 acres), to permit a 6,344 square foot automobile convenience use, all of which is described herein (Proposal No. 149-66P-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Coleman requested a hearing from the public on this bill which had been previously advertised. BILL NO. BL2015-30

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to SP zoning for property located at 4190 Dodson Chapel Road, at the southwest corner of Dodson Chapel Road and Dodson Chapel Court (7.2 acres), to permit a daycare of up to 207 persons within an existing facility, all of which is described herein (Proposal No. 2014SP-006-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Rhoten moved to defer the bill to the December public hearing, which motion was seconded and approved by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R8 to SP zoning for property located at 1820 12th Avenue South, at the northeast corner of 12th Avenue South and W. Grove Avenue (0.22 acres), to permit a mixed-use development with up to six residential units and 1,000 square feet of general office, all of which is described herein (Proposal No. 2015SP-079-001). The bill was approved by the Planning Commission with conditions, disapproved without. Mr. Sledge requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and citizens were heard in favor of and in opposition to passage of the bill.
