ORDINANCE NO. BL2015-35

An ordinance approving a Third Supplemental Agreement to Lease No. DACW62-1-76-1412 between The Metropolitan Government of Nashville and Davidson County and the Secretary of the Army pertaining to the Percy Priest Dam and Reservoir Project (Proposal No. 2015M-032PR-001).

WHEREAS, by Lease No. DACW62-1-76-1412, dated January 12, 1976, the Secretary of the Army granted The Metropolitan Government of Nashville and Davidson County a lease to use and occupy land and water area, over, under, and across approximately 790 acres, more or less, within the Percy Priest Dam & Reservoir Project, more particularly shown as Exhibits A and B of said Lease; and,

WHEREAS, said Lease was granted for a term of 50 years, beginning November 1, 1975 and ending October 31, 2025; and,

WHEREAS, it has been discovered by the Secretary of the Army that the original mapping, as reflected on Exhibit A of said Lease, did not include the appropriate water area; and,

WHEREAS, the parties desire to amend the Lease by entering into a Third Supplemental Agreement for the purpose of deleting Exhibit A and replacing it with Exhibit A-1, attached hereto; and,

WHEREAS, Exhibit A-1 attached to the Third Supplemental Agreement covers the appropriate water area granted under the original lease, which encompasses a larger area than the original map; and,

WHEREAS, approval of the Third Supplemental Agreement is in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. That the Third Supplemental Agreement to Lease No. DACW62-1-76-1412 between The Metropolitan Government of Nashville and Davidson County and the Secretary of the Army, attached hereto and incorporated herein by reference, is hereby approved and the Metropolitan Mayor is authorized to execute said Agreement on behalf of the Metropolitan Government.

Section 2. That any further amendments to Lease No. DACW62-1-76-1412 shall be approved by resolution of the Metropolitan Council receiving at least twenty-one affirmative votes.

Section 3. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
