ORDINANCE NO. BL2015-7

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 85 linear feet of existing two inch water main and to accept 129 linear feet of eight inch water main and one fire hydrant assembly for properties located at 4105 and 4107 Hillsboro Pike, (MWS Project No. 15-WL-82 and Proposal No. 2015M-044ES-001).

WHEREAS, the abandonment of approximately 85 linear feet of existing two inch water main and the acceptance of 129 linear feet of eight inch water main and one fire hydrant assembly for properties located at 4105 and 4107 Hillsboro Pike are needed to construct MWS Project No. 15-WL-82; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-044ES-001 on August 27, 2015, for the abandonment and acceptance of said water mains and fire hydrant assembly.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 85 linear feet of existing two inch water main and to accept 129 linear feet of eight inch water main and one fire hydrant assembly for properties located at 4105 and 4107 Hillsboro Pike, as shown below and on Exhibit 1, which is attached hereto and incorporated by reference:

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
