ORDINANCE NO. BL2015-34

An ordinance approving an option agreement between The Metropolitan Government of Nashville and Davidson County and the Tennessee Wildlife Resources Foundation, Inc., and authorizing the granting of a conservation easement on a portion of certain property owned by the Metropolitan Government, located at 2009 Sevier Street (Tax Parcel No. 09402022900) (Proposal No. 2015M-033PR-001).

WHEREAS, The Metropolitan Government of Nashville and Davidson County and the Tennessee Wildlife Resources Foundation, Inc. (“TWRF”), desire to enter into an Option Agreement, attached hereto, pertaining to certain property (“Property”) owned by the Metropolitan Government, located at 2009 Sevier Street (Tax Parcel No. 09402022900); and,

WHEREAS, the Option Agreement provides for the Metropolitan Government to grant TWRF an option to obtain a conservation easement pursuant to the Tennessee Conservation Easement Act of 1981, across a portion of said Property to protect certain streams, wetlands, riparian areas, and surface areas within the watershed of the Property; and,

WHEREAS, the form of the Conservation Easement to be granted upon TWRF’s exercise of the option is attached hereto to said Option Agreement; and,

WHEREAS, approval of the Option Agreement and authorizing the granting of said Conservation Easement is in the best interest of the citizens of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

Section 1. The Option Agreement attached hereto, between The Metropolitan Government of Nashville and Davidson County and the Tennessee Wildlife Resources Foundation, Inc., granting the Tennessee Wildlife Resources Foundation, Inc., an option to obtain a Conservation Easement on a portion of the Property located at 2009 Sevier Street (Tax Parcel No. 09402022900), is hereby approved.

Section 2. The Director of Public Property Administration is hereby authorized to execute said Option Agreement.

Section 3. The Director of Public Property Administration is hereby authorized to execute and record such documents as may be necessary to carry out the granting of an easement on the Property to the Tennessee Wildlife Resources Foundation, Inc., in the form of the Conservation Easement attached hereto.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
