ORDINANCE NO. BL2015-42

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 250 linear feet of existing sanitary sewer main and easement and to accept 332 linear feet of eight inch sanitary sewer main and easement and two manholes for properties located at 2209, 2211, 2213, 2215, and 2217 29th Avenue South, (MWS Project No. 15-SL-56 and Proposal No. 2015M-036ES-001).

WHEREAS, the abandonment of approximately 250 linear feet of existing sanitary sewer main and easement and the acceptance of approximately 332 linear feet of eight inch sanitary sewer main and easement and two manholes for properties located at 2209, 2211, 2213, 2215, 2215, and 2217 29th Avenue South are needed to construct project number 15-SL-56; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2015M-036ES-001 on July 9, 2015, for the abandonment and acceptance of said sewer mains, easements and manholes.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 250 linear feet of existing sanitary sewer main and easement and to accept approximately 332 linear feet of eight inch sanitary sewer main and easement and two manholes for properties located at 2209, 2211, 2213, 2215, and 2217 29th Avenue South, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
