Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by former Pastor Wayne Reese.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Metropolitan Action Commission
Reappointment of Ms. Brenda Dowdle for a term expiring February 2, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Robert Stockard for a term expiring February 2, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Fire and Building Code Appeals Board
Appointment of Mr. William Steffenhagen for a term expiring February 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Historical Commission
Reappointment of Mr. Don Cusic for a term expiring February 2, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Hospital Authority
Appointment of Mr. John Regniald Hill for a term expiring November 4, 2019. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Nashville Education Community and Arts TV (NECAT)
Reappointment of Mr. Joel Sullivan for a term expiring February 5, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Ms. Stephanie Taylor for a term expiring February 5, 2015. Ms. Taylor will fill the unexpired term of Mr. Mark Miller. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. David Wicker for a term expiring February 5, 2017. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Wastewater Hearing Authority
Appointment of Mr. Jay Tant for a term expiring October 1, 2014. Mr. Tant will fill the unexpired term of Mr. John Barnes. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

- CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-990

A resolution approving an application for an Arts Build Communities Grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Arts Commission, to conduct community arts projects in Davidson County. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-991

A resolution approving a memorandum of understanding for a grant between The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office and the Fund for Cities of Service, Inc. to fund the implementation of Team Dean Reading Coaches using impact volunteering as a key strategy. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-992

A resolution approving a contract with CSS International for technology consulting services for the Information Technology Services Department. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-993

A resolution accepting a grant from the State of Tennessee, Department of Labor and Workforce Development, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Nashville Career Advancement Center, to participate in the Incumbent Worker Training Program to upgrade current workers’ skills (LW09F141IWRSP14). The resolution was approved by the Budget and Finance and Personnel-Public Information-Human Resources-Housing Committees.

RESOLUTION NO. RS2014-994

A resolution accepting a grant from Boulevard Bolt, Inc. to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Social Services Commission, to move the most vulnerable people from the streets into supportive housing. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-995

A resolution approving an application for a Big Band Dances Grant from the State of Tennessee, Tennessee Arts Commission, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Parks and Recreation Department. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-996

A resolution accepting a package of grants from the Friends of Warner Parks to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation, to provide staffing for Warner Parks Center, Nature Center support, and the SWEAT Program for additional labor for summer maintenance. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-997

A resolution approving Amendment Five to a grant from the State of Tennessee, Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Finance, to provide public assistance pursuant to Presidential Disaster Declaration number FEMA-1909-DR-TN to complete repairs and/or replacement to facilities damaged during April and May 2010. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-998

A resolution approving a Safe Routes for Schools grant application for a grant from The Tennessee Department of Transportation to The Metropolitan Government of Nashville and Davidson County for Lakeview Design Center School. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-1000

A resolution requesting Nashville Electric Service to implement the Change for Charity program. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-1002

A resolution recognizing the 25th Anniversary of Book’em. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1003

A resolution recognizing the National Education Association and the Metropolitan Nashville Education Association's "Read Across America" day on March 3, 2014. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-1004

A resolution recognizing The Rotary Club of Nashville as it celebrates its 100th Anniversary. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-948

A resolution appropriating Thirteen Million One Hundred Thousand Dollars ($13,100,000) from the Undesignated Fund Balance of the Metropolitan Nashville Public Schools General Purpose Fund for the benefit of Metropolitan Nashville Public Schools. Mr. Mitchell offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE RESOLUTION NO. RS2014-948

A resolution appropriating Four Million Three Hundred Thousand Dollars ($4,300,000) from the Undesignated Fund Balance of the Metropolitan Nashville Public Schools General Purpose Fund for the benefit of Metropolitan Nashville Public Schools. The resolution was approved by the Education Committee; the Budget and Finance Committee recommended to defer the resolution to the second meeting in March. Mr. Mitchell moved to adopt the resolution, which motion was seconded. RESOLUTION NO. RS2014-984

A resolution requesting the Davidson County Delegation to the Tennessee General Assembly to introduce and support the necessary legislation to provide a dedicated funding source for local mass transit. The Budget and Finance and Traffic, Parking and Transportation Committees recommended deferment to the second meeting in May. Mr. Tygard moved to defer the resolution to the second meeting in May, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-988

A resolution amending Substitute Resolution RS2012-489 appropriating $1,050,000 of income from the Capitol Mall Urban Development Action Grant (UDAG) to the Metropolitan Development and Housing Agency for the benefit of affiliates of HCA Holdings, Inc., including Parallon Business Solutions, LLC, HealthTrust Purchasing Group, L.P., and Sarah Cannon Holdings, LLC, and for job recruitment efforts. An ordinance authorizing the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County to negotiate and accept payments in lieu of ad valorem taxes with respect to affiliates of HCA Holdings, Inc., including Parallon Business Solutions, LLC, HealthTrust Purchasing Group, LP, and Sarah Cannon Holdings, LLC. The bill was approved by the Budget and Finance Committee. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-999

A resolution accepting a grant from the State of Tennessee, Tennessee Wildlife Resources Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Water and Sewerage Services, to construct and operate a boat dock to be located at the Omohundro Water Treatment Plant. The resolution was approved by the Public Works Committee; the Budget and Finance Committee recommended deferment. Mr. Steine moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-1001

A resolution supporting the Tennessee Common Core standards, and opposing all state action that would discontinue the use of the standards or delay their implementation. The resolution was approved by the Education Committee. Ms. Gilmore moved to adopt the resolution, which motion was seconded. Mr. Mitchell moved to defer the resolution to the second meeting in March, which motion was seconded and failed by a roll call vote. BILL NO. BL2014-687

An ordinance to provide for the designation of public property within specified areas of downtown Nashville as a temporary “Special Event Zone” during the time period beginning at six o’clock (6:00) a.m. on Wednesday, April 2, 2014, and ending at six o’clock (6:00) p.m. on Wednesday, April 9, 2014, relative to the use of these areas in conjunction with the 2014 National Collegiate Athletic Association (NCAA) Women’s Final Four Basketball Tournament and related activities and events. Upon motion duly seconded, the bill passed first reading and was referred to the Codes, Fair and Farmers Market, and Convention, Tourism and Public Entertainment Facilities Committees by a voice vote of the Council.

BILL NO. BL2014-688

An ordinance approving agreements for the lease and disposition of real property relating to the Bordeaux Long Term Care and J.B. Knowles Home for the Aged facilities, an amendment to the Intergovernmental Agreement between the Metropolitan Nashville Hospital Authority and the Metropolitan Government of Nashville and Davidson County, and determining and declaring in accordance with Section 1.05 of the Metropolitan Charter that the private sector can provide quality long term care services on a more economical basis, which makes such services no longer necessary as a governmental function (Proposal No. 2014M-002PR-001). An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 1,500 linear feet of six inch public water main along with public fire hydrants and all easement rights and also to abandon eight inch public sewer mains and all easement rights associated with these mains for properties located along George E. Davis Boulevard, Charlotte Avenue, Shankland Street and Nelson Merry Street (Project Nos. 14-SL-004 and 14-WL-003 and Proposal No. 2014M-005ES-001). The bill was approved by the Planning Commission. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Tulip Grove Road Stormwater Improvement Project for four properties located at 906 and 910 Tulip Grove Road and Tulip Grove Road (unnumbered) (Project No. 14-SWC-092 and Proposal No. 2013M-060ES-001). The bill was approved by the Planning Commission. BILL NO. BL2014-694

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR to MUN-A zoning for properties located at 1318, 1322 and 1326 6th Avenue North, at the southeast corner of 6th Avenue North and Taylor Street (0.88 acres), all of which is described herein (Proposal No. 2014Z-005PR-001). The bill was approved by the Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Planning, Zoning and Historical Committee by a voice vote of the Council.

BILL NO. BL2014-663

An ordinance declaring surplus and approving the disposition of a certain parcel of real property located at 3515 Gallatin Pike, commonly known as Jere Baxter Middle School (Proposal No. 2013M-048PR-001). The bill was approved by Planning Commission. The Budget and Finance, Education and Planning, Zoning and Historical Committees recommended deferment. Ms. Bennett moved to defer the bill, which motion was seconded and adopted by a voice vote of the Council.

Without objection Bill Nos. BL2014-665 and BL2014-666 were considered together.

BILL NO. BL2014-665

An ordinance amending Ordinance No. O65-464, as amended by Ordinances Nos. O68-525 and 080-294, relating to the levy of a local option sales and use tax by the Metropolitan Government to increase the amount of the tax for the purpose of funding mass transit and providing additional funding for Metropolitan Nashville Public Schools. The Budget and Finance Committee recommended deferral to the second meeting in May.

BILL NO. BL2014-666

An ordinance amending Chapter 5.32 of the Metropolitan Code to increase the amount of the annual commercial vehicle regulatory license and the motor vehicle regulatory license to provide a local dedicated funding source for mass transit. Mr. Tygard offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2014-666

An ordinance amending Chapter 5.32 of the Metropolitan Code to increase the amount of the annual vehicle regulatory license fee to provide a local dedicated funding source for mass transit for the purpose of regulating traffic control. The Budget and Finance Committee recommended deferral to the second meeting in May. The Traffic, Parking and Transportation recommended deferral to the second meeting in May.

Mr. Tygard moved to defer the bills to the second meeting in May, which motion was seconded. Mr. Steine moved to table the motion to defer, which motion was seconded and failed by a roll call vote. The matter recurred on the motion to defer and was adopted by a voice vote of the Council.

BILL NO. BL2014-667

An ordinance amending Chapter 2.78 of the Metropolitan Code pertaining to the Fairgrounds Master Plan, and appropriating $200,000 to the Board of Fair Commissioners from the Reserve for State Fair Subsidy account in the General Fund of the General Services District. The bill was approved by the Budget and Finance Committee. Ms. Moore moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-668

An ordinance approving a memorandum of understanding between The Metropolitan Government of Nashville and Davidson County and Belmont University to create a Joint Information Center on the Belmont University campus in the event of a major disaster. The bill was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees. Mr. Steine moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing the acquisition of certain right-of-way, permanent easements, and temporary construction easements and property rights by negotiation or condemnation for use in public projects of the Metropolitan Government, initially for purposes of Public Works Department Project Number 2013-B-3, Gulch Pedestrian Bridge (Proposal No. 2013M-045PR-001). The bill was approved by Planning Commission, Budget & Finance, Public Works and Planning, Zoning and Historical Committees. Ms. Gilmore moved to pass the bill on second reading, which motion was seconded. Mr. Tygard moved to defer the bill indefinitely, which motion was seconded. BILL NO. BL2013-588

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to SP zoning for properties located within the Woodland-in-Waverly Historic Preservation District at 2107, 2111, and 2115 White Avenue, approximately 195 feet south of Prentice Avenue (0.57 acres), to permit up to 8 residential dwelling units, all of which is described herein (Proposal No. 2013SP-033-001). The bill was approved by the Planning Commission with conditions, disapproved without. The bill was approved by the Planning, Zoning and Historical Committee.
