ORDINANCE NO. BL2014-692

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 1,500 linear feet of six inch public water main along with public fire hydrants and all easement rights and also to abandon eight inch public sewer mains and all easement rights associated with these mains for properties located along George E. Davis Boulevard, Charlotte Avenue, Shankland Street and Nelson Merry Street (Project Nos. 14-SL-004 and 14-WL-003 and Proposal No. 2014M-005ES-001).

WHEREAS, the abandonment of 1,500 linear feet of six inch public water main along with public fire hydrants and all easement rights and also to abandon eight inch public sewer mains and all easement rights associated with these mains for properties located along George E. Davis Boulevard, Charlotte Avenue, Shankland Street and Nelson Merry Street are needed to construct project numbers14-SL-004 and 14-WL-003; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2014M-005ES-001 on January 29, 2014, for the abandonment of said water and sewer mains, fire hydrants, and all associated easement rights.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to abandon approximately 1,500 linear feet of six inch public water main along with public fire hydrants and all easement rights and also to abandon eight inch public sewer mains and all easement rights associated with these mains for properties located along George E. Davis Boulevard, Charlotte Avenue, Shankland Street and Nelson Merry Street, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the abandonment authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
