Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Police Chaplain James Duke.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Barry, Steine, Garrett, Tygard, Matthews, Harrison, Hunt, Banks, Scott Davis, Westerholm, Anthony Davis, Bennett, Pridemore, Pardue, Glover, Stites, Stanley, Claiborne, Tenpenny, Moore, Allen, Gilmore, Baker, Langster, Weiner, Evans, Holleman, Harmon, Blalock, Dominy, Johnson, Potts, Bedne, Dowell, Todd, Mitchell and Neighbors (37); Absent: Maynard, McGuire, Duvall (3).

The Minutes of the regular meeting of January 21, 2014, were approved.

- ELECTIONS AND CONFIRMATIONS -

Alarm Appeal Board
Appointment of Mr. James R. Zant for a term expiring November 4, 2015. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Arts Commission
Reappointment of Ms. Marielena Ramos for a term expiring January 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Farmers Market
Appointment of Ms. Kia Jarmon for a term expiring May 5, 2016. Ms. Jarmon will fill the unexpired term of Mr. Josh Smith. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Work Release Board (Nominee of Sheriff Daron Hall)
Reappointment of Dr. Doug Morgan for a term expiring January 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Without objection, RS2014-986 was taken out of order.

RESOLUTION NO. RS2014-986

A resolution recognizing February 2014 as American Heart Month and Friday, February 7, 2014, as National Wear Red Day. The resolution was approved by the Rules-Confirmations-Public Elections Committee. The resolution was approved by the Rules-Confirmations-Public Elections- Committee. An ordinance to amend Section 17.16.160 of the Metropolitan Zoning Code to clarify that historic home events must be inside a historically significant structure (Proposal No. 2014Z-003TX-001). Mr. Garrett moved to defer the bill to the March public hearing, which motion was seconded and adopted by a voice vote of the Council.

An ordinance to amend Title 17 of the Metropolitan Code, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS20 to RS30 zoning various properties located on Esteswood Drive, north of Trimble Road and west of Estes Road (19.6 acres), all of which is described herein (Proposal No. 2013Z-050PR-001). The bill was approved by the Planning Commission. Mr. Todd requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Todd moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-622

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R15 to IWD zoning for a portion of property located at 2487 Pulley Road, approximately 1,460 feet north of Couchville Pike (5.5 acres), all of which is described herein (Proposal No. 2013Z-041PR-001).
The bill was approved by the Planning Commission. Ms. Johnson moved to defer the bill to the March public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-630

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS40 to SP zoning for properties located at 6030 and 6034 Sedberry Road, at the southwest corner of Sedberry Road and Old Harding Pike (1.34 acres), to permit up to eight single-family detached residential units, all of which is described herein (Proposal No. 2013SP-041-001). The bill was approved by the Planning Commission, with conditions and disapproved without. Ms. Evans requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by making applicable the provisions of the Hillsboro-West End Neighborhood Conservation Overlay District to various properties located along 25th Avenue South, 27th Avenue South, Ashwood Avenue, Chesterfield Avenue, Hillside Drive, Natchez Trace, Overlook Drive, Sunset Place, W. The bill was disapproved by the Planning Commission. Ms. Blalock requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from approximately 17.1 acres from OL to AR2a, approximately 6.38 acres from CL to CS (and approximately 10.75 acres from CS to CS) for a portion of property located at 7435 Old Hickory Boulevard, approximately 1,675 feet west of I-24 (34.13 acres), all of which is described herein (Proposal No. 2014Z-001PR-001). The bill was approved by the Planning Commission.

An ordinance amending Chapters 17.04, 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the regulation of temporary music events, all of which is more specifically described herein (Proposal No. 2014Z-004TX-001).
Ms. Allen offered a substitute ordinance and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2014-651

An ordinance amending Chapters 17.04, 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, pertaining to the regulation of small outdoor music events, all of which is more specifically described herein (Proposal No. 2014Z-004TX-001). Ms. Allen moved to defer the bill to the March public hearing, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-652

An ordinance amending Sections 17.04, 17.08, 17.16 and 17.20 of Title 17 of the Metropolitan Code pertaining to animal hospitals, kennels/stables, veterinarians and animal boarding facilities in Nashville and Davidson County all of which is more particularly described herein (Proposal No. 2013Z-015TX-001). The bill was approved by the Planning Commission. Mr. Hunt requested a hearing from the public on this bill which had been previously advertised. RESOLUTION NO. RS2014-973

A resolution approving Amendment One to the grant from the Friends of Centennial Park and Parthenon to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Parks and Recreation Department, to provide funding for one employee’s salary. The resolution was approved by the Budget and Finance and Parks, Library and Recreation Committees.

RESOLUTION NO. RS2014-974

A resolution approving amendments eight and nine to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to protect air quality to achieve established ambient air standards and protect human health. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-975

A resolution approving an intergovernmental agreement between The Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and the Tennessee Association of Chiefs of Police, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-976

A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and Dickson County, by and through the Dickson County Sheriff’s Office, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-977

A resolution approving an intergovernmental agreement between the Metropolitan Government of Nashville and Davidson County, by and through the Metropolitan Nashville Police Department, and the City of Cookeville, by and through the Cookeville Police Department, for the distribution of state grant funds to assist with investigations of internet crimes against children. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-978

A resolution approving a PAWS Animal Shelters Grant from The Community Foundation of Middle Tennessee to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Sheriff’s Office, in collaboration with the Metropolitan Animal Control Center to build and provide animal shelters. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-979

A resolution accepting a grant from the State of Tennessee, Department of Finance and Administration, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Police Department, to fund a Pilot Program to provide direct services to victims from high crime areas of the greater Metropolitan Nashville area and Davidson County. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-980

A resolution approving an intergovernmental agreement by and between the State of Tennessee, Department of Transportation, The City of Brentwood, and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for a regional traffic management study and traffic signal optimization effort on several intersections within Southern Davidson County and Williamson County City of Brentwood under the Surface Transportation Program, PIN 119204.00. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-981

A resolution approving an interlocal agreement by and between The City of Brentwood and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Public Works, for a regional traffic management study and traffic signal optimization effort on several intersections within Southern Davidson County and Williamson County City of Brentwood under the Surface Transportation Program. The resolution was approved by the Budget and Finance and Public Works Committees.
