ORDINANCE NO. BL2014-658

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept temporary easements for the Boyd Drive Stormwater Improvement Project for five properties located at 4141 and 4162 Ames Drive, 4170 Bobwhite Drive, 4121 Boyd Drive, and 4127 Meadow Hill Drive (Project No. 13-SWC-209 and Proposal No. 2013M-057ES-001).

WHEREAS, the negotiation and acceptance of temporary easements for five properties located at 4141 and 4162 Ames Drive, 4170 Bobwhite Drive, 4121 Boyd Drive, and 4127 Meadow Hill Drive, are needed to construct Stormwater Project 13-SWC-209; and,

WHEREAS, the Metropolitan Planning Commission approved mandatory referral No. 2013M-057ES-001 on November 20, 2013, for the negotiation and acceptance of temporary easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. The Metropolitan Government of Nashville and Davidson County is authorized to negotiate and accept temporary easements for five properties located at 4141 and 4162 Ames Drive, 4170 Bobwhite Drive, 4121 Boyd Drive, and 4127 Meadow Hill Drive, as shown on Exhibits 1 and 2, which are attached hereto and incorporated by reference.

Section 2. The Directors of Water and Sewerage Services and Public Property Administration are authorized to execute such documents as may be necessary and appropriate to carry out the negotiations and acceptance authorized by this ordinance.

Section 3. Amendments to this legislation shall be approved by resolution.

Section 4. This ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
