Metropolitan Council Meeting

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Darren Jernigan.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

I am writing to inform you that effective Wednesday, January 22, 2014 I will be resigning as a Member of the Metro Council where I serve the people of Old Hickory, Lakewood and Hermitage in District 11.

When appropriate, I respectfully ask that you consider Councilmember-at-Large Megan Barry to serve the people of District 11 until an election can be held on August 7, 2014.

Reappointment of Mr. Charles Scott for a term expiring January 31, 2016. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Mr. Joseph Presley for a term expiring January 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Planning Commission
Appointment of Ms. Lillian M. Blackshear for a term expiring March 31, 2015. Ms. Blackshear will fill the unexpired term of Rev. Judy Cummings. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Denis Blackwelder for a term expiring January 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Appointment of Mr. Larry Bryant for a term expiring January 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Reappointment of Dr. Doug Morgan for a term expiring January 1, 2018. At the request of the appointee, the confirmation was deferred.

Reappointment of Mr. Don D. Purdy for a term expiring January 1, 2018. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Barry moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

RESOLUTION NO. RS2014-972

A resolution confirming the appointment of Waverly Crenshaw to the board of directors of The Convention Center Authority of the Metropolitan Government of Nashville and Davidson County. The resolution was approved by the Rules-Confirmations-Public Elections Committee.

RESOLUTION NO. RS2014-962

A resolution exempting the Treehouse Restaurant located at 1011 Clearview Avenue from the minimum distance requirements for obtaining a beer permit pursuant to Section 7.08.090.E. of the Metropolitan Code. The resolution was approved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Westerholm requested a hearing from the public on this Resolution which had been previously advertised. The President asked if anyone desired to be heard for or against the resolution and no one came forward to be heard. The President declared the public hearing closed. - CONSENT AGENDA RESOLUTIONS -

RESOLUTION NO. RS2014-951

A resolution extending the license and franchise of Nashville Gas Company for an additional period. The resolution was approved by the Budget and Finance and Public Works Committees.

RESOLUTION NO. RS2014-964

A resolution approving Amendment One to a Financial Empowerment Centers Grant from the Cities for Financial Empowerment (“CFE”) Fund to The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office of Economic and Community Development, to support municipal efforts to improve the financial stability of households by leveraging opportunities unique to local government. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-965

A resolution approving the Third Amendment to the Charging Site Host Agreement between the Metropolitan Government and Blink Acquisition, LLC, a Car Charging Company, as successor in interest to Electric Transportation Engineering Corporation d/b/a ECOtality North America, to amend the License Agreement between those parties. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-966

A resolution approving an application for a Major Cultural Institution grant from the Tennessee Arts Commission to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Arts Commission. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-967

A resolution approving an application for a Teacher Training grant from the Tennessee Arts Commission to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Nashville Arts Commission, to fund a teacher cadre to develop common core unit plans and professional development sessions based on Civil Rights Public Art. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-968

A resolution accepting a donation from Fred’s Inc. to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Fire Department in conjunction with the annual “Hero Hat” Campaign. The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-969

A resolution approving a contract with Helicorp to supply helicopter parts for the Metropolitan Nashville Police Department.
The resolution was approved by the Budget and Finance and Public Safety-Beer and Regulated Beverages Committees.

RESOLUTION NO. RS2014-970

A resolution approving a sub-recipient grant agreement by and between the Metropolitan Development and Housing Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Department of Social Services/Metropolitan Homelessness Commission, to provide rental and utility deposits for individuals assessed as chronically homeless using the Vulnerability Index. The resolution was approved by the Budget and Finance and Health, Hospitals and Social Services Committees.

RESOLUTION NO. RS2014-971

A resolution authorizing the Metropolitan Department of Law to compromise and settle the property damage claim of the Borden Dairy Company against the Metropolitan Government of Nashville and Davidson County in the amount of $16,344.00, and that said amount be paid out of the Self-Insured Liability Fund. The resolution was approved by the Budget and Finance Committee.

RESOLUTION NO. RS2014-948

A resolution appropriating Thirteen Million One Hundred Thousand Dollars ($13,100,000) from the Undesignated Fund Balance of the Metropolitan Nashville Public Schools General Purpose Fund for the benefit of Metropolitan Nashville Public Schools. The Budget and Finance and Education Committees recommended deferment. Mr. Mitchell moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2014-963

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Fifteen Million Dollars. Mr. Steine offered a substitute resolution and moved that it be accepted for filing and which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE RESOLUTION NO. RS2014-963

Initial resolution determining to issue general obligation bonds of The Metropolitan Government of Nashville and Davidson County in an aggregate principal amount of not to exceed Twenty-One Million Dollars. The Budget and Finance recommended deferment. Mr. Steine moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-660

An ordinance amending section 2.140.030 of the Metropolitan Code of Laws, pertaining to the membership of the Davidson County Public Records Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Personnel-Public Information-Human Resources-Housing and Rules-Confirmations-Public Elections Committees by a voice vote of the Council.

BILL NO. BL2014-661

An ordinance approving a Memorandum of Understanding (MOU) between the United Way of Metropolitan Nashville and The Metropolitan Government of Nashville and Davidson County, acting by and through the Mayor’s Office of Economic and Community Development, to define each party’s responsibilities in implementing the Financial Empowerment Center model. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2014-662

An ordinance accepting the donation of $139,380 to the Metropolitan Government for the use and benefit of the K9 Unit of the Metropolitan Nashville Police Department and the donation of $113,592.92 to the Metropolitan Government for the use and benefit of Metro Animal Care and Control. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance Committee by a voice vote of the Council.

BILL NO. BL2014-663

An ordinance declaring surplus and approving the disposition of a certain parcel of real property located at 3515 Gallatin Pike, commonly known as Jere Baxter Middle School (Proposal No. 2013M-048PR-001). The bill was approved by Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Budget and Finance, Education and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2014-664

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon an approximately 18 foot by 260 foot easement that was previously retained by Council Ordinance O86-1491 (no utilities located within these easement rights) for property located at 2000 Galbraith Drive (Proposal No. 2013M-059ES-001). The bill was approved by Planning Commission. Upon motion duly seconded, the bill passed first reading and was referred to the Public Works and Planning, Zoning and Historical Committees by a voice vote of the Council.

BILL NO. BL2013-494

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to MUN-A zoning for properties located at 1916, 1918, 1920, 2000, 2002, 2004 and 2006 Eastland Avenue, opposite Scott Avenue (0.98 acres), all of which is described herein (Proposal No. 2012Z-028PR-001). The bill was approved by the Planning Commission and Planning, Zoning and Historical Committee. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2013-603

An ordinance to amend Chapters 2.62 and 11.12 of the Metropolitan Code pertaining to the regulation of small outdoor music events on commercial property. The Codes, Fair and Farmers Market and Public Safety-Beer and Regulated Beverages Committees recommended indefinite deferment. Mr. Mitchell moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-654

An ordinance amending Section 7.08.140 of the Metropolitan Code pertaining to the permitted hours of beer delivery. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Westerholm moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-655

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent easements for the Nashua Stormwater Improvement Project for three properties located at 607 and 609 Nashua Drive and 616 Waco Lane (Project No. 14-SWC-081 and Proposal No. 2013M-058ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Baker moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2014-656

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon easement rights retained in former alley #995 (right-of-way abandoned via Ordinance #O76-385) and easements retained in an unnumbered alley (right-of-way abandoned via Ordinance #O79-1480) and to partially abandon approximately 170 feet of a 20 foot sewer easement that was recorded in Deed Book 5152, Page 195, for properties located at 711 Gallatin Avenue, 719 Gallatin Avenue, 714 North 12th Street, and 800 North 12th Street (Proposal No. 2013M-055ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to abandon approximately 350 linear feet of an existing utility easement recorded in Plat Book 6250, Page 457, for property located at 7747 Indian Springs Drive (Proposal No. 2013M-056ES-001). The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Ms. Weiner moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept temporary easements for the Boyd Drive Stormwater Improvement Project for five properties located at 4141 and 4162 Ames Drive, 4170 Bobwhite Drive, 4121 Boyd Drive, and 4127 Meadow Hill Drive (Project No. 13-SWC-209 and Proposal No. 2013M-057ES-001).
The bill was approved by the Planning Commission, Public Works and Planning, Zoning and Historical Committees. Mr. Matthews moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
